My dear Sir:- | have yours of the 9th inclosing two letters from Levi syphus, also yours of the 13th fro m Los Angeles, inclosing Copy of Complaint and summons in the case of George vs Latimer et al. You have the Original Summons or else Murphy has it and I wish you would get it and send it along as no doubt I will have to serve Charlie Stewart, as he has not as yet answered my letter. Levi Syphus seems to be dovet-ailing with Laiinet’s. He has ab­solute power to take all of the water and.all of the. improvements and cultivated lands and we must see to it that he does or resigns. Latimer must be.getting supplies and water there and he need not give him water at all if he is not desirable there. However it is up to him and if he does not look after matters we must see to it that he does. Of course I cannot advise him in the matter, and he will have', to get counsel unless he can use a little horse sense himself. The N. W. 1/4 of the i|| ¥. l/4 of Geo. 16 , cannot be located away from you under any of the U. s. Laws if a portion of the subdivision is in ary manner improved by you. However I think it would be well to script it with Forest Re­serve script| (you should be able to get some in Los .Angeles) which will cost you from$6 to per acre as it has gone up lately. I can get some in Denver. How in regard tothe spring three miles further on, I would suggest that you go out there and get possession peac^iblyif possible and if not that we bring ejectment and get an injunction and you put a tenant on the Place and make something out of it this fall and wlhter. If something is not done to this end you will lose the revenue of Mesquite Springs, and will be injured at Indian Creek. You should look after the Sold Spring matter also and see to it that they do not enter upon your land for any purpose whatever. There is no right of appropriation of water except from a natural channel or stream and if this creek or stream as I understand it does not flow away from your land, no one has any right to the water, but yourself. ' I think, as soon as the weather cools a little you should take a surveyor and do a little rusticating in the vicinity of you Desert ( 2 ) P r o p e r t y . Can then see you! If it keeps work however I will postpone the trip. You can advise me what you will want done at Mesquite and Cold springs, but be su^e of your land as this is not improved in any way as I understand it and if we were mistaken in the land , and compelled anyone to get off we would be stuck for damages. What is Robinson doing with his suit | and has there been any return made on the service of the summons & etc. I wrote Robinson for fee and haiP3 not heard from him. My dear Sir:- I got notice that Court would sit on the 3rd of October, 1905, and I inclose you Original Subpoena and four copies and you better get tip to Las Vegas the latter part of the Month and serve such witnesses as you ray think proper. What we will want to prove is that the}' both claimed the place and delied that you had any interest therein, and the receipts from October, 1904, to the time of the appointment of the receiver. I think you should have Towner if he knows anything about any statements they’" made of receipts , or of them claiming the property, for th/e-^reason that he is familiar with the land and can swear to the corners & etc. | am inclosing you the answer of Belle Latimer, and you can return it to me af+er reading it as I will want it here. She and George filed separate answers but they are about the same. When you get to Las Vegas you and Levi can determine who will be proper witnesses. Get good Ren if you can. My dear si.rt — | have youre of the 21st with inclosure of answer Belle Latimer and note what you say. Tt will be Impossible for me to go to Las regas befwseCourtI as | must be in Pioche the 27th and remain over for the Commissioners meeting, on the 2nd|and Court meets on the third. However I presume Whitt©more is just tslicing and that if they really wish to settle they will make s#me decent offer. I feel that ‘ everything^ is'.well. X am convinced that Judge Brown will wake a just settlement, we have nothing 'to settle- as we have done what was right and always wanted to. if they jumped in to defraud us let them take the consequences, tf course a settlement is always better than the expense of a suit, but I do not like this underhanded business of selling to Bracken. Pont let them bluff you George, and you will come out all right. Whittemore wants the place for nothing and if you hold on he will pay. His Company are good people and do not approve of this kind of work, but he gets out and makes all kinds of combinations, and if he succeeds will blow to his people what he has accomplished. You better deal with Latimer^ and leave Whittemore to me, for I can ha ndle him, know him like I book. Go ahead and make all kinds of perparations for suit and if they are anxious to settle we can settle at Pioche.
