    twenty-five cents ($1.25) per acre, good and law ful money of the United Stales, payable OjS hereinafter
    expressed, by the party o f the second part, doth agree to convey to the party o f the second part, by good
    and sufficient patent, in fee simple, the following-described lands, to-w it:

    patent for the same, issued in the name of the applicant.
    / f HIS CONTRACT^ MADE UPON THE EXPRESS COND TIONS, viz.: That i f the said

    principal sum herein specified, or the interest thereon, according to tile terms of this Agreement, as
    herein stipulated, the lands herein described, and the money paid thereon, shall immediately and
    unconditionally revert to the Stale o f Nevada, and the lands be thereafter subject to sale m the same
    manner and under the same conditions as though this Contract of Sail had not been m ade; provided,
    that the State Land Register is hereby authorized to accept an overdue M erest paym ent on this Contract
    during the period of one year from the date required for such interest paym ent; but when application is
    made"for any portion of the land described in this Contract on which the annual interest paym ent is
    overdue it shall be the duty of the State Land Register to immediately jdeclare such Contract forfeited
    and to accept and certify such application, and the remainder of the land embraced in such forfeited

    From him we learn ed th at the onl}' survey which had been made fo r Mrs.
    Stew art was one made by her son. In our con versation s w ith Mr. Stewart
    we learned th at the l i n e s , as run by him, included o n ^ one o f the
    sp rin g s - there were se v e r a l sp rin gs which were rep resen ted to our c lie n t
    to be on the land th at he was purchasing. We f e e l th at i t would be an
    unnecessary expense to have another survey made, as the survey which was
    made for Mr. Werner does not in clu d e any o f the sp rin gs, and the one made
    by Mr. Stewart in c lu d e s only one, and th at our c lie n t i s e n tir e ly j u s t if
