At this time the Commission considered the petition protesting the granting of the variance to Carl Hyde to construct guest rooms on a parcel of land adjoining his residence at 1001 Bedford Road, which was approved by the Commission on July 10, 1956. The Assistant City Attorney advised the Commission that this petition filed was not in proper order since none of the signers had protested at the original hearing held by the Board of Adjustment. Acting Mayor Bunker announced to thos protestants present that in order to secure further action on this matter that a petition in proper form would have to be filed no later than July 20, 1956. Those present who objected to the granting of this variance and appeared before the Board in this regard were: Mr. Arthur Thomas H200 W. Charleston Mrs. Carolyn M. Miller 1025* Bedford Road City Engineer Wade recommended that Bid No. 56.35 for the furnishing of fertilizer to the City of Las Vegas be awarded to the low bidder, Clark County Wholesale in the amount of $9,067.88. Commissioner Sharp moved the recommendation of the City Engineer be accepted and Bid No. 56.35 awarded to Clark County Wholesale. Motion seconded by Commissioner Fountain and carried by the following vote: Commissioners Fountain, Sharp and Acting Mayor Bunker voting aye; noes, none. Absent: Commissioner Whipple and Mayor Baker. At this time City Engineer Wade made the recommendation that the low bid of Garden Center in the amount of $2,243.50 for Bid No. 56.36, grass seed for the City, be accepted. Commissioner Fountain moved the recommendation of the City Engineer be accepted and Bid No. 56.36 awarded to the Garden Center. Motion seconded by Commissioner Sharp and carried by the following vote: Commissioners Fountain, Sharp and Acting Mayor Bunker voting aye: noes, none. Absent: Commissioner Whipple and Mayor Baker. City Engineer Wade recommended that Bid No. 56.31 for the construction of the rehabilitation Farm Building be awarded to the low bidder, Paul Smitley in the total amount of $43,247.00, subject to the furnishing of the required performance and labor bonds. Commissioner Sharp moved the recommendation of the City Engineer be accepted and Bid No. 56.31 awarded to Paul Smitley Company in the total amount of $43,247.00, subject to filing of the necessary bonds and other specified requirements. Motion seconded by Commissioner Fountain and carried by the following vote: Commissioners Fountain, Sharp and Acting Mayor Bunker voting aye; noes, none. Absent: Commissioner Whipple and Mayor Baker. The City Engineer recommended that Bid No. 56.32 for the construction of additions and remodeling of the City Jail be awarded to the low bidder, Ben O. Davey Construction Company, based on Alternate Nos. B-1 and B-2, in the total amount of $104,830.00. Mr. Wade advised the Commission that the next low bidder on this project was Sierra Construction Company in the total amount of $104,885.00. Commissioner Fountain moved the recommendation of the City Engineer that Bid No. 56.32 be awarded to Ben O. Davey Construction Company, based on Alternate Nos. B-1 and B-2 in the total amount of $104,830.00, subject to the filing of the necessary bonds and other specified requirements. Motion seconded by Commissioner Sharp and carried by the following vote: Commissioners Fountain, Sharp and Acting Mayor Bunker voting aye; noes, none. Absent: Commissioner Whipple and Mayor Baker. City Engineer Wade requested that the award of Bid No. 56.18 for the installation of a traffic signal system and street lighting project be held until a later portion of the meeting. At this time City Engineer Wade recommended that Bid No. 56.25 for the construction of a Sewage Treatment Plant be awarded to the low bidder, Lembke, Clough & King, in the total amount of $1,107,969.36. Commissioner Sharp moved the recommendation of the City Engineer be accepted and Bid No. 56.25 awarded to Lembke-Clough & King in the total amount of $1,107,969.30 subject to the filing of the necessary performance and labor bonds and other specified requirements. Motion seconded by Commissioner Fountain and carried by the following vote: Commissioners Fountain, Sharp and Acting Mayor Bunker voting aye; noes, none. Absent: Commissioner Whipple and Mayor Baker. Commissioner Fountain moved the request of General Builders Inc. for payment of the 10% retention on the construction of the lavatories at the Golf Course in the total amount of $301.70 be approved and the warrant issued.
