S e c t io n 8 , WORK TO BE DONE TO SATISFACTION OP ENGINEER The perform ance o f th e work s h a l l be under th e d i r e c t i o n and s u p e r v is io n o f th e E n g in e e r, i t b e in g u n derstood, however, t h a t th e R a ilr o a d Company s h a l l not be r e s p o n s ib le f o r th e methods s e l e c t e d by the C o n tr a c to r f o r th e C o n t r a c t o r 's own conven ien ce in p e r fo rm in g the work, and th e E n gin eer s h a l l have f u l f power t o con ­demn and r e j e c t any o r a l l work and/or m a t e r i a l which, in h is o p in io n i s u n s a t i s f a c t o r y o r which does not conform w ith t h e s p i r i t o f t h i s c o n t r a c t , and a l l such im p e r fe c t or i n s u f f i c i e n t work and/ or m a t e r i a l s h a l l be im m e d ia te ly remedied or removed by and a t th e expense o f th e C o n t r a c to r and t o th e s a t i s f a c t i o n o f the E n gin eer; and in th e even t th e C o n tr a c to r s h a l l f a i l so t o do, th e Engineer s h a l l have th e power at any tim e t o tak e out any d e f e c t i v e work and/or m a t e r ia l and r e b u i l d or r e p la c e the same at th e expense o f th e C o n t r a c to r ; i t b e in g understood and a g r e e d , how ever, th a t the f a i l u r e o f th e E n gin eer to d e t e c t f a u l t y or d e f e c t i v e workmanship and/or m a t e r i a l du rin g th e p r o g r e s s o f th e work s h a l l not be con­s tru e d as an a ccep tan ce t h e r e o f u n t i l a f t e r th e f i n a l com p letion and a ccep tan ce o f the work as a whole co vere d by t h i s c o n tr a c t by th e R a ilr o a d Company. Any and a l l m a t e r i a l which has been r e j e c t e d by the En­g i n e e r f o r any cause w h atso ever s h a l l be p l a i n l y marked by the Con­t r a c t o r a t th e d i r e c t i o n o f th e E n gin eer so as t o i d e n t i f y th e same and s h a l l be removed from th e premises o f th e R a ilr o a d Com­pany and e n t i r e l y away from th e v i c i n i t y o f th e work by and at t h e expense o f th e C o n t r a c to r . The rem oval o f th e im p e r fe c t m a t e r ia l as in t h i s S e c t io n p r o v id e d r e f e r s o n ly t o th e m a t e r i a l fu r n is h e d by th e C o n t r a c to r . S e c t io n 9. EXTRA. WORK I t i s understood and agreed th a t th e R a ilr o a d Company s h a l l have th e r i g h t t o make such changes in- th e amount, dimen­s io n s o r c h a r a c t e r o f th e work t o be done hereu n der, as, i n th e op ­i n i o n o f th e E n g in e e r, th e i n t e r e s t s o f th e work o r o f th e R a i l ­road Company may r e q u i r e ; and i f any such changes o r a l t e r a t i o n s should d im in is h the q u a n t it y o f th e work t o be done th e y s h a l l not c o n s t i t u t e a c la im f o r damages f o r a n t i c i p a t e d p r o f i t s on th e work so dispensed w it h .
