VII-E-statement for the record-SENATOR FLEISCHMAN stated that the banners had been ordered by Vice-President Mills and Director Araiza. Vice-President Mills according to former business manager, Lori Callison, requested that she spilt two LPO's to pay for the banners thereby circumventing the Senate. Nevada Student Affairs-inquired about status of Regent Handbook changes and Non-Discrimination policy. Thanked people that came to support World AIDS Day events. If more people from Student Government do not support Student Government activities, then how can we expect students to . In the food drive, Intervarsity Christian Fellowship won first place, Ethnic Student Council won second place, and Student Nurses Association won third. b. Elections-is making changes to the policy. c. Organizations-meeting Tuesday, December 5, 6:30. no meeting next week. d. Student Services-shuttle is still broken. e. E & P-officially done for the semester. Movie Nine Months did well. Would like feedback on how the Senate felt about the activities of the last semester. C. FACULTY SENATE REPORTS a. SENATOR LAXAGUE-attended Curriculum last Friday, working on a new catalog. Several colleges are changing some of their pre-requisites. b. Scott Schwartz-Commissions meeting on December 13,11:00 a.m. c. SENATE KIMMET-Next Academic Budget meeting is January 23. D. BUSINESS MANAGER REPORT Business Manager Karla Kirk gave recommendation of revisions to current budget, and informed the Senate of Executive Board expenditures. V. PUBLIC COMMENT [in accordance with N.R.S. 241.020 (2)(c)(3)] Residence Hall Liaison-Leah Griffith-Residence Halls are trying to arrange a acquisition of scantrons for the halls. President Smith instructed her to talk to Student Services Director Greenhalgh. Keith McLain-reminded the Senators to speak in front of their classes, this is the last week that they can do it fore this semester. SENATOR KIMMET inquired as to how a stipend is defined and how that related to signing E-Docs and employment. SENATOR MOORE explained that Business Manager Karla Kirk stated that relating to the IRS, it is considered employment and money for a service. Senate President Smith passed the gavel to Senate President Pro-Tempore Moore and addressed the Senate regarding New Business Item B. Questioned that there were no specific charges listed, and stated that the item is on the agenda for the Rules and Ethics Committee meeting. Asked the Senate how they felt about the item being ruled out of order because the item is to go to Rules and Ethics and according to Bylaw 31, the chair would then present the committee findings to the Senate. SENATOR LAXAGUE that if the committee is to be formed or the investigation by Rules is to happen, charges need to be brought on the floor of the Senate by a Senator. SENATOR FLEISCHMAN stated that she was requested to remove this item twice from the agenda so that it may go to Rules, she chose not to do that. It is fine that the Rules committee has the item on their agenda, but she is utilizing her right as a Senator to bring charges. As for specific charges, the charge is stated as misfeasance, if a listing of those charges is wanted, Michelle Alexander has them and is prepared to list them at the time of the item. 2 SENATE MINUTES 26-05 / DECEMBER 4, 1995 Senate President Smith re-acquires the gavel and chair of the meeting. Maryum Ali-historian for the Black Student Association addressed the Senate regarding Carl Tolbert and the alleged character attack by the Rebel Yell. Questioned why Carl Tolbert's character has not been defended by the Senate. SENATOR KIMMET addressed her that there have been a couple of Senators that have made rebuttal comments to the Rebel Yell. Tenesha Bell-treasurer for the Black Student Association addressed the Senate regarding BSA submitting articles to the Rebel Yell about the situation involving Carl Tolbert and those articles have not been published. BSA is in support of Carl Tolbert and believe that he did nothing wrong or unethical. Regarding the charge of misfeasance-requested a reading of the charges. Senate President Smith questioned if the charges could be read when the item is up on the agenda, Ms. Bell agreed. Kenya Chase-president of the Black Student Association addressed the Senate as also a member of the Communications College, stating that she believed he would provide proper representation to the communications constituents. Questioned the Senates opinions regarding the people questioning Carl Tolbert's actions, and those people's lack of participation in the general elections. SENATOR KIMMET responded that how the Senate personally feels about the people bringing the charges has no bearing on the situation and whether some unethical was committed. Regardless of how anyone on the Senate feels about the situation, what is needed is facts so the situation can be rectified. SENATOR TROTTER replied that her questions have nothing to do with the individuals bringing charges, but rather if Carl Tolbert has represented himself equally within the communication classrooms, and the fact that most of the communication students that she has spoken with were unaware that they had a Senate representative on the Senate, nor did they know who filled that seat. SENATOR FLEISCHMAN replied regarding questions as to why the other candidates did not run in the general election should be posed to the other candidates on an individual basis, people have personal and different reasons for not running in a general election. The question is not whether Carl Tolbert is good Senator, the questions whether or not he misrepresented himself on the application. Scott Schwartz-stated that the he has witnessed that the communications students are circulating a petition, and stated to the Senate that if there are enough signatures collected on that petition, the investigation is a mute point, because a new election would be automatic. SENATOR KIMMET sated that as a Senator he has heard about the petition, but has yet to see one. SENATOR TOLBERT questioned the procedure regarding the new election resulting from a petition when there was no original election. No one ran for the open communication seat, he was appointed. Regina Calhoun-secretary of the Black Student Association addressed the Senate stating that she tried to contact Ms. Shealy, and she never returned the phone calls. She did try to obtain information from the registrar similar to how Ms. Shealy states she obtained Carl Tolbert's information, and the procedure was not the same. Questioned, therefore, Ms. Shealy's methods of obtaining the information. The ethics questions against Carl Tolbert should be questioned against Ms. Shealy also by the Senate. Stated that if the people bringing the charges and asking for the removal of Carl Tolbert should not be allowed to acquire the seats if they choose to run in the general election. SENATOR FLEISCHMAN replied that the information regarding the classes that Carl Tolbert has taken in the Communications College was given out be a doctor in the college. SENATOR KIMMET replied that actions taken by someone that is not a Senator is beyond the control of the Senate They have no jurisdiction to control or answer for what that person does. SENATOR PEREZ sated that the accusations against Ms. Shealy are all regarding actions that no one is sure she even committed. Ms. Calhoun questioned people are allowed to attend the Rules and Ethics committee meeting and put forth their comments and debates at that time. SENATOR CARROLL informed her that the meeting is open to the public, Thursday, 6:00 p.m. in the Student Government offices. Breck Nester-addressed the Senate regarding procedures of the communications college and the accessibility to records rather than going through the registrar. 3 SENATE MINUTES 26-05 / DECEMBER 4, 1995 V. NEW BUSINESS A. Move into a vote. Motion passes 20-0-0. Senate President Smith calls a five (5) minute recess at 6:50 p.m. Senate President Smith calls the meeting back to order at 6:58 p.m. B. Discussion/approval of the formation of an impeachment committee to investigate charges of misfeasance by Communications Senator Carl Tolbert Motion to approve made by SENATOR FLEISCHMAN, seconded by SENATOR CAMPBELL. SENATOR FLEISCHMAN reads the charges against Carl Tolbert: Misfeasance is defined by the dictionary as—the performance of a lawful action in a n illegal or improper manner. It is the contention that Carl Tolbert's application for Senator for the Greenspun School of Communication after the general election and three days prior to the Senate vote to the open seat representing the Communication school was done improperly. She has brought the investigative committee as opposed to committing it to Rules and Ethics as a result of the current controversy surrounding the Rules committee and to have the matter resolved. Because the committee is formed does not mean there will be an impeachment, it just means there will be an investigation with a committee that has the ability to impeach if it deemed the necessary action. SENATOR FLEISCHMAN yields the floor to Michelle Alexander. Michelle Alexander spoke to the Senate. This is not a personal attack on Carl Tolbert as a person, but on his position as Senator. Urged the Senate to go about this decision as colleagues, not as friends of Carl Tolbert. Questioned how Carl Tolbert could be chosen to represent the Communications College when that person has not been an involved member of the Communications department other than being a member of the Debate team, which is an activity open to all university students, not communication majors. Presented a petition signed by 65+ people in the communications college stressing concerns regarding Carl Tolbert as the Communications representative. Asked Dr. Gary Kreps, the Executive Director of the Greenspun School to attend the meeting, but he related to Ms. Alexander that this is a student issue that he does not want to be involved in, but is in full support of the concerns about the representation for Communications. She feels that there have been opportunities that Carl Tolbert could have taken to redeem himself, yet he has not taken steps to counter any of the charges. SENATOR TROTTER questioned Ms. Alexander as to her creating this petition before Senator Tolbert had the opportunity to speak with communications constituents, and the legality of the procedure used to obtain the information about Senator Tolbert. Ms. Alexander stated that she has no idea how the informatin was gathered, but if it was gathered illegally, she is in support of actions taken against that person also. Ms. Alexander replied also that she does fell the petition is fair becuase it has been three weeks since this subject was brought to the Senate, and Carl Tolbert has had those three weeks to speak to the Communications students and to publicly deal with these charges, which he has not. SENATOR KIMMET requested details regarding Senator Tolbert's paperwork when he applied for the seat, Senate President Smith replied that Carl Tolbert's paperwork was completed properly within the guidelines of the CSUN Constitution and it was all legal. Motion to table the item to enable Don Fuller to speak made by SENATOR CARROLL, seconded by SENATOR HOWARD. Motion passes by unanimous consent. 4 SENATE MINUTES 26-05 / DECEMBER 4, 1995 Don Fuller, General Manager of KUNV, addressed the Senate thanking them for their cooperation this year. The station is in good shape, and they are trying to appeal to a broader audience. They are working with athletics, performing arts, alumni association, and the Barrick Lecture Series. The problem facing the station at this point is growth and resulting space limitation. They have grown out of the area that they have in the union. Move back into New Business-Item B. SENATOR KIMMET stated that he is favor of this committee to get something done and get the facts out so that the Senate can have answer to the situation one way or another. SENATOR PEREZ yield the floor to Student Body Vice-President Joe Mills-The Constitution is the law and regulation that CSUN must follow. Carl Tolbert did not run in the general election for this seat, he was appointed by the Senate. If the Senate wanted to look into this situation further, they could have tabled his nomination to the seat, but they chose not to do this. The petition from the students is null and void, being that the rules state that the petition must contain 10-% of the people that voted in the election. The communications people signing the petition did not even vote in the last election that we had since there was no one running for their seat. Added also, that is someone feels that something improper has been committed, they should file a judicial case. SENATOR CARROLL stated that since this item is already in Rules and Ethics, there is no need to form two committees. SENATOR CAMPBELL-would support SENATOR CARROLL in the position of it going to Rules and Ethics if the charges had been brought by a Senator, but they were brought up by an outsider and sponsored by a Senator. She feels that the Senate is being charged as a whole to be accountable for their actions, not just charges about what Carl Tolbert may have done, and therefore the Senate should have more of an open forum as to what is chosen to be done, rather than it go to the Rules and Ethics Committee that was chosen by the Senate President. Also agrees that the petition was not fair, and biased to Michelle Alexander's side of the issue. SENATOR TOLBERT spoke regarding the petition and the number of pre-majors in the Communications College that are not admitted to the college but can vote for the Senate seat. The number of signitures on the petition is small compared to that number of students in the school. Ms. Alexander responded that the petition is not a request for a recall, it is simply a petition for support of reignation or impeachment. There are 530 Communications students, and the 65 signitures is what she has in her posession, but there are more petitions circulating. Motion to move into a committee of the whole made by SENATOR CARROLL, seconded by SENATOR BLOCK. Move into a vote. Motion passes 15-3-1. SENATORS LAXAGUE, KIMMET, TOLBERT opposed. SENATOR ANDERSON abstained. Motion to move back into session made by SENATOR PEREZ, seconded by SENATOR KIMMET. Move into a vote. Motion passes 19-0-0. SENATOR AGUERO yields the floor to Tod Story. Tod Story addressed the Senate as a Communications major, and stated that the question at hand is whether the students of the Greenspun School of Communication want Carl Tolbert as their representative on the Senate. The charges are not claiming that what Carl Tolbert did was illegal, only that it was improper. A further point that the first election was flawed because Communications students voted as liberal arts 5 SENATE MINUTES 26-05 / DECEMBER 4, 1995 students, Carl Tolbert still lost that election with the communications sytudents being part of that voting body. Motion to call to question made by SENATOR FENDELL, seconded by SENATOR KIMMET. SENATOR FLEISCHMAN yielded the floor to Steve Hagen. Steve Hagen addressed Senate with support for Carl Tolbert on behalf of himself and other students in the Communications College that believe that Carl Tolbert can give adequate service to the students of the Communications college. Move into a vote. Motion passes 14-5-0. SENATORS LAXAGUE, TOLBERT, FLEISCHMAN, ZUREK, CAMPBELL opposed. Move into a vote of New Business-Item B. Motion passes 17-0-2. SENATORS TOLBERT, GRIFFITH abstained. Motion to nominate an afministrator and Senators to the impeachment committee, two minute speeches from each nominee, to be followed by a division of the house and roll call vote made by SENATOR LAXAGUE, seconded by SENATOR ANDERSON. Motion to nominate Dr. Terry Piper as administrator to the impeachment committee made by SENATOR CARROLL, seconded by SENATOR HOWARD. Dr. Terry Piper accepted the placement on the committee. The motion is approved unanimously. Motion to nominate SENATOR KIMMET made by SENATOR PEREZ, seconded by SENATOR SPANTON. Motion to nominate SENATOR CARROLL made by SENATOR HOWARD, seconded by SENATOR ANDERSON. Motion to nominate SENATOR AGUERO made by SENATOR TRUJILLO, seconded by SENATOR MOORE. SENATOR KIMMET received 9 votes. SENATOR CARROLL received 3 votes. SENATOR AGUERO received 4 votes. SENATOR TRUJILLO received 3 votes. SENATOR FLEISCHMAN received 6 votes. SENATOR SOLOMAN received 1 vote. SENATOR TROTTER received 1 vote. SENATOR MOORE received 4 votes. SENATORS KIMMET, FLEISCHMAN. Emergency motion to uphold the contract passed in the 25th Senate session regarding Thunder Hockey ticket promotion and sales made by SENATOR CAMPBELL, seconded by SENATOR MOORE. Director Brian Saliba addressed the Senate and explained the contract and details regarding the need for the re-approval. Business Manager Karla Kirk addressed the contract and the details of the need for re-approval. The wording of the contract was unclear, and the need is present now for re-approval of the contract. Move into a vote. Motion passes 20-0-0. VIII. OPEN DISCUSSION SENATOR LAXAGUE-Vice-President Mills' evaluations of the directors is right on target and he is doing a good job of maintaining professional records of their evaluations. SENATOR ANDERSON-Has been an intense meeting, hope that this situation can be resolved as soon as possible. SENATOR SOLOMAN-Disappointed he wan not able to be part of the committee, but is looking forward to the findings. SENATOR SPANTON-Urged the committee to look at both sides of the issues, and not at personal sides of it, just to determine the facts. SENATOR KIMMET-Glad the committee was formed, so there is no doubting, there is just a result of what is found. Promised a fair and impartial investigation. SENATOR PEREZ-Great to see the amount of student participation in the Senate meeting. Encouraged more student involvement from the gallery with the Senate. SENATOR TOLBERT-Is making this statement in response to the articles and statements from students. He did not do anything illegal, he followed the Constitution of CSUN. People have ventured from the matter to character, and that is not what is at issue. Questioned why Michelle Alexander did not run in the general election, why deans and professors asked students to run in the general election, and the students now voicing concerns did not run then. Motion to allow Carl Tolbert as much time as is needed to make his statement up to the limit that is allowed in Robert's Rules of Order [10 minutes] made by SENATOR FENDELL, seconded by SENATOR AGUERO. Move into a vote. Motion passes unanimously. SENATOR TOLBERT (cont.)-Stated that he wondered what people have been questioning. He only accessed a system that is available for students to access. If someone has a problem with that, it is a personal belief and moral judgment that should not be expressed publicly, which makes Senate look as if they do not know what they are doing. If the information the Catherine Shealy claims she got is so easy to access, then the system needs to be changed. Refuted the statement that when he spoke to the Senate during his speech for appointment, all he spoke about was the Black Student Association and Multicultural Student Affairs. He cited that he was involved with those organizations, but that was not all that he 7 SENATE MINUTES 26-05 / DECEMBER 4, 1995 adressed, he spoke of UNLV TV, the Greenspun Lecture Series and the Communications Schools access to those events. The Rebel Yell printed these falsifications, and these shoulkd not have been printed if they were not factual. Faculty should not get involved in student-student conflicts. He should not have spoken to the Rebel Yell and the Yell should not have printed his comments [in reference to Gary Kreps], Responding to the statement that Michelle Alexander was dissapointed that the Senate did not do the reasearch into Tolbert before the appointment, responded there was no research to do. The application was turned in and he gave a speech about his qualifications and why he would make the best Senator representative for the Communications College. The Senate does not need to know his entire life history. Rebel Yell hjas has had innadequate investistigation. Hopes that the Senate disregards the articles in the Yell, and knows they are not factual. Gave the Senate permission to give thir constituents his home phone number so he may answer any questions that they may have. Stated that he hopes the Commnications student show the same amount of concern and support of future CSUN events that they have for this subject. SENATOR GRIFFITH-Thanked Senator Tolbert for making a statement and proividing information that the Senators can relate to their constituents now. SENATOR FLEISCHMAN-Good to have such a large turnout for the Senate meeting. Hope to see it again and often. STUDENT BODY VICE-PRESIDENT MILLS-Advised the comittee not to go by the popular opinion of the time, but is right and what is legal and what occured. Encouraged people to apply for the open positions on the Judicial Council. SENATOR BLOCK-Hopes the matter is resolved soon, feels that Carl Tolbert is a good Senator. SENATOR HOWARD-Does not feel as a member of the Elections Board that the evaluation of Director Araiza represents the work that she has put in. SENATOR CARROLL-There is a lot of work to be done wiyth the impeachment committee. Hopes the committee will expedite the matter. SENATOR WONG-Hopes the committee finds its results quicklky and unbiased. Likes the student participation in the meetings and hopes it continues. Is always willing to speak with any student at any time. SENATOR FENDELL-Gives Senator Tolbert credit for making a speech and answering to the allegations. Has now provided the Senate with some information with which to answer questions from constituents. Whjen consiering his position representing the Communications school, look at his qualifications from the last Senate session and previous experience that he has had. Remindded the committee to keep ion mind the qustions are about whether he violated the constitution or broke any regulations, not the currrent opinion of his character. SENATOR TRUJILLO-Expressed support of the formation of the impeachment commitee to find the truth in the situation and to let everyone know what that truth is. SENATOR AGUERO-Commended Senator Tolbert on speaking, but nothing came out of the speech regarding what actually happened. The committee needs to find whether there was wrong doing or not, and get this behind the Senate. Expressed concern that a student made the statement that several editiorials had been submitted to the Rebel Yell that had not been printed. That problem needs to be looked at. SENATOR ZUREK-Agreed with Senator Aguero's opinion, and commended Senator Tolbert on his speech. 8 SENATE MINUTES 26-05 / DECEMBER 4, 1995 SENATOR CAMPBELL-Heads of Department's need to stay out of situations like this. In responsw to the students in the Communications Department that feel they are being unjustly served, it was unfortunate that they could not vote for a candidate inn the genera;l election, but keep in mind that situation existed because there was no one running for that seat before petitions are started saying that the department doesn't want someone to be their representative. Expressed concern that Senator Carroll stated that his vote is representative of only the people in his college and she does not agree with that. Speaking to any and all students in the rsponsibilty of the Senators. Believes Carl Tolbert is doing his job as a Snator. SENATOR TROTTER-Stated her support regarding the ability of both Senators recently appointed to the committee to do a fair job. Referencing the issue surrounding fellow senator Carl Tolbert, she addressed the gallery and stated that while she was gladdened in seeing active participation from students-at-large enrolled in the School of Communication who came personally to speak to the senate, she was also saddened to overhear a remark which she considered to be a racial slur. She said that she felt the person(s) who made this unfortunate remark to be misguided and issued an open challenge to "... the people behind the white sheets to come up to the pulpit and speak their peace."
