NOW, THEREFORE, the conditions of the above obliga­tions are such that if the Contractor shall well and truly save harmless and indemnify the Railroad Company and the Lessor Company from and against any and all claims and de­mands or liens whatsoever for labor performed upon or skill or other necessary services bestowed upon, or for appliances, teams or power furnished or for materials to be used or con­sumed in the work to be performed under said contract, and shall also complete in all its parts all the work described in said contract within the time and in the manner therein specified and shall also observe, perform, fulfill, and keep all and every the covenants and agreements in said contract on the part of the Contractor to be kept, performed or com­plied with within the time and in the manner therein specified, and shall also pay in full the claims of any and all persons performing labor upon or furnishing materials to be used in said work, then this obligation to be void,* otherwise to , remain in, full force and effect. ' ' j ,/• ? No change or alteration of the work, extension of time or other rhodification of said contract shall release or exonerate any Surety or Sureties upon this bond. It is ex­pressly agreed and understood that this bond is made and executed contemporaneously with the contract above mentioned, and in consideration of the covenants and agreements therein made and entered into on the part of the Railroad Company; and that the due execution and delivery hereof is a condition precedent to liability on the part of the Railroad Company on said above mentioned contract. It is further agreed and understood that this bond is made in compliance with Sections 3737 to 3753* both inclusive, of Nevada Compiled Laws of 1929* and all acts amendatory thereof and supplemental there­to; and this bond shall inure to the benefit of any and all persons who perfprm labor upon or furnish materials to be used in the work to be performed under said contract so as to give such persons a right of action to recover upon this bond in any suit brought to foreclose any lien or liens or in a separate suit brought on this bond.
