*7.. m \ water delivered to water users; provided, that if the Public Service Commission of Nevada, after investigation and public hearing on its own motion or upon complaint filed by the state engineer, the state health department, or any city official including city water inspector, or by any other party, shall determine that there has not been made or that there is reasonable cause to believe that there will not in the future be made a reasonable and beneficial use of water by said water users dD resulting in unnecessary wasting of water, or that the use made of said water is to the detriment of the water reserves of the ' QMA* State of Nevada or to the detriment of the health and safety of its inhabitants, the said Public Service Commission, if it then determines it to be in the public interest and welfare so to do, may permit the installation and use of mechanical water meters or similar mechanical devices to measure the quantity of water so delivered and to establish the proper rate of compensation therefor; provided, that nothing in this act herein contained shall be construed to interfere with the systems of metering water employed in any town, city, or village of this state as currently established upon the effective date of this act; provided, that nothing in this section shall prohibit the installation or use of water meters in connection with the wholesale delivery or sale of water by any public utility or the installation or use of test water meters for the purpose of checking the consumption of water of any user or users of water; provided further, that nothing in the immediate foregoing proviso shall apply to cities and towns owning and operating municipal water works, The commission may, in its discretion, purchase such materials, apparatus and standard measuring instruments for such examination and tests as it may deem necessary.
