Action Item: Discussion/Approval of an ad hoc committee to investigate the 2003 Senate Elections. As submitted by Senate President Pro-tempore Goatz. (See Attachment 33.32-01) B. Action Item: Discussion/Approval of (l)one student to serve as Senator for the College of Engineering. As submitted by Senate President Amesquita. C. Informational Item: Business Manager Dave Hill will be presenting to the Executive Board Members, Directors and Senate Chairs the policies, procedures and guidelines of the Nevada Open Meeting Law. ADJOURNMENT Posted in accordance with Nevada Open Meeting Law (N.R.S. 241.000) at the following locations: Moyer Student Union, Frank & Estella Beam Hall, Flora Dungan Humanities, and the Classroom Building Complex. MICHAEL J. AMESQUITA To the CSUN Senate and Executive Board: I am proposing an opportunity for collaboration regarding Alcohol Awareness Week (October 19-25). I had intended to, but was unable to, snag you or your rep after the last Alcohol Task Force Meeting. This would be a great opportunity to pull several areas of campus together to address the issues of alcohol related issues education and outreach. Bridget and I met to brainstorm the start of a programming schedule for the week. Here is what we have been able to come up with so far: Mon, Tues and Wed- Sober Driver Pledges MSU Counterspace 10-2 Wed- Staff Development - Rick Barnes (tentative) MSU 11-ish Sobriety Field Testing Games CBC/DC area 2:30-3:30 Drunk goggle big wheel races & ring toss MPE 3:30-4:30 Pida Plaza 4:30-5:30 Mocktail Reception & Games Recognition MSU Ballroom 6:00 Drink Think Program - Rick Barnes MSU Ballroom 6:30 This by no limitation is the exclusive list of programs for the week, more the skeletal base we have come up with. I have broken the current ideas into resource/supply needs, as well as, resources currently being considered/solicited: Sober Driver Pledge DriveRebel Service Council is considering the sponsorship of staffing Rick Barnes - Currently secured through the Greek Life budget and seeking supplemental funds to assist (Speaker fees of $2500) CSUN well review proposal for possible sponsorship Rick Barnes identified a $500 sponsorship scholarship available through NCAA for athletics Sobriety Field Testing Games. Game Supplies available through Student Health Services Proposal for Public Safety involvement being considered: -Stop DUI visibility/sponsorship currently being sought -Game Prize Packages- Currently seeking a solicitor to secure donations -Mocktail Reception-Current proposal being considered by Sodexo Bridget is checking with John for possible assistance through Pepsi. Please feel free to provide any feedback or suggestions and let me know if you and/or your area would be willing and interested in providing. I would be more than happy to attempt the scheduling of a meeting for us all to come to the table provided each of you could send your times of availability. Purpose To investigate and compile a report to given to the Senate about the 2003 Senate elections II. Structure The ad hoc Elections Investigation Committee shall consist of the following: a. The Chair of the committee shall be Senator Langhaim b. The remainder of the committee shall consist of Senator Arneson, Senator Wagner and one (1) CSUN member III. Duties, Powers, and Responsibilities a. The Chair shall have the power of subpoena if necessary i. Subpoena's shall be administered in person if possible ii. For all others an e-mail or a telephone contact shall suffice iii. The subpoena shall include the following: 1. A request from the chair to appear 2. The time at which to appear before the committee 3. Contact information of the chair so that the witness may be given the opportunity to present a valid reason not to appear before the committee iv. Failure for a stipend positions to appear before the committee shall be noted in the report and may result in a reduction of stipend v. Failure for candidates that ran in the election to appear shall be noted in the report and may result in CSUN withholding a portion of their filing fee vi. Failure for a non-remunerated CSUN member to appear before the committee shall be noted in the report and may be barred from CSUN Services for the remainder of the semester b. The Committee: 1. Shall be charged with conducting an investigation into the recent election 2. Shall compile a report to be submitted to the Senate at the end of their investigation a. The report shall contain any information obtained from the interviews that is deemed to be pertinent to the election b. Senators may submit questions to the committee to ask i. The committee is not obligated to ask questions submitted. It is solely at their discretion c. Shall contain a list of all people interviewed and 1 d. All those who were contacted and not interviewed along with recommendations of reprimand if deemed necessary 3. All committee members must be present while interviewing people involved. Only those findings from those interviews shall be put into the report 4. All questions asked must be related to the election 5. The interviewee has the right to refuse to answer 6. Upon presentation of the committee's report the following actions may be taken at the Senate meeting at which the report is presented a. Actions that may be taken include but are not limited to: i. A directive to the CSUN Vice President and the elections director to correct the mistakes ii. Recommending to the Senate to enforce the sanctions specified in title III that may be applied if failure to comply with the subpoena exists. 1. Sanctions may only be enforced by a 2/3 vote of the Senate iii. May recommend any other actions deemed necessary by their findings 7. No agenda needs to be posted for each individual interview because this is a purely investigative committee and no decisions will be made at the interviews 8. The committee must hold one (1) meeting in to finalize the report. That meeting must conform to Open Meeting Law 9. May employ CSUNRS 325.02 IV. Date of expiration This ad hoc committee sunsets upon completion of its investigation and its presentation of the report to the Senate
