Description

On a report that the railroad was not fulfilling its duty to supply water to the Stewart burial plot, Bracken and others visited the site and reported on their findings. An excerpt from the original Stewart deed is referenced below.

Las Vegas - June 30, 1939 W 18-1-12 Mr. Leo A. McNamee, General Attorney, Las Vegas, Nevada. Dear Leo: Referring to our recant conversation regarding complaint of Attorney Hinman representing the Stewart heirs that we were not living up to our agreement to deliver four inches of water to the Stewart burial plot. Sunday morning Folger, Neeley, and myself made personal inspection of the burial plot and found a stream of water eighteen or twenty inches wide running into the plot at that time. This was made possible by cooperation of the people in response to our advertisements to conserve water, and also the additional water received from the emergency pump in railroad yards which runs direct into the city mains. This is for your information and record. For convenience I attach excerpt from the original dead which we looked up from the Pioneer Title records. Very truly yours, WALTER R. BRACKEN, cc - Mr. E. E. Bennett. Vice-President and Agent. Ed: You will recall we had the same trouble in previous years, at which time you advised that it was not our obligation to carry the water from the Creek to the Burial Plot, and Leo did not agree. But since examination of the deed at the Title Insurance office, I believe he now - 2 - agrees that all we are required to do is to serve the 4 inches of water at the measuring weir, alongside the Creek. As to the ditch leading from the Creek to their burial plot, we have nothing to do with that. W.R.B.
