Sheet b of (3) / of all the parties hereto, contributing in proportion to the amount of water they receive therefrom* In the event that the supply of water through the Ho nor ins Pipe line shall fail to the said defendant George Denton he shall have the privilege until the new pipe line shall be built by the plaintiffs as hereinbefore mentioned of receiving from the plaintiff through the Stockton Ditch such a drinking stream as is hereinbefore allotted to the defendant Elisabeth Wilson , to be taken in the same manner and to the same amount and under the same conditions* defendants or either of them from conveying by pipe or flues their portion of the waters of Soldier Canyon Creek to their lands from any point on said creek above the present head of the Stockton Ditch, prior or subsequent to the construction of a pipe line by the plain­tiffs or the people of Stockton; but suoh improvement shall not oper­ate in any manner to diminish or impair the rights of the plaintiffs or their successors* It is farther ordered, adjudged and decreed that unless on or before the first day of November , 1901 , the parties hereto shall establish to the satisfaction of the Court the apparatus , weirs and devices, properly and satisfactorily constructed for the accomplish­ment of the division of the waters at the head of the Stockton Ditch as hereinbefore set forth , the court reserves the power under this iAAMii nfett ftatwtint a nwsnut and oomostent engineer to devise and con— of one half* It is further ordered, adjudged and decreed that eaoh party has waived all damages claimed against the other, and that eaoh party shall pay hie own costs* Done in open Court this second day of July , 1901.
