    Whereas, the City of Las Vegas heretofore and on the 14th, day of January, 1935, entered into an agreement with Las Vegas Post Number 8, The American Legion, Department of Nevada, in substance and to the effect that the City of Las Vegas upon the said American Legion Post expending the sum of Five Thousand ($5000.00) Dollars or upward upon the erection of a Memorial Building upon land then under lease from the City to the said Post, that the City would thereupon lease to the said Post for a period of fifty years lands upon which the said building was situate, and, WHEREAS, it appearing to the Board at this time that the said Post has expended a sum far in excess of Five Thousand ($5000.00) Dollars upon the construction of a building upon said land, and, WHEREAS, it appearing to the Board that the letter and intent of the said agreement should be complied with and good cause appearing therefore, it is, ORDERED AND DIRECTED that the Mayor of the City of Las Vegas execute a lease for and on behalf of the said City with the Las Vegas Post Number 8, The American Legion, Department of Nevada, conveying the following described premises. Commencing at the northeast corner of Block Thirty-Three (33) of Clark's Las Vegas Townsite as per map of said Townsite on file and of record in the office of the County Recorder of Clark County, Nevada, thence along the prolongation of the easterly line of said Block 33 N. 28?13' E. eighty (80) feet to the point of beginning; thence N. 61? 47' W. 275.0 feet; thence No. 28?13' E. 300.0 feet; thence No. 68°01'20" E. 117.15 feet; thence S. 61?47' E. 200.0 feet; thence S. 28?13' W. 390.0 feet to the point of beginning , comprising a net area of 2.385 acres. by lease in form as the hereunto annexed copy for a period of fifty years at the annual rental of One ($1.00) Dollar per year payable in advance, said term to commence the first day of September, 1935." NOW THEREFORE, the said lessor, for and in consideration of the rents covenants and agreements hereinafter contained and reserved on the part and behalf of the Lessee, to be paid, kept and performed, does by these presents grant, demise and let unto the said Lessee all of that said real property described as follows; Commencing at the Northeast corner of Block Thirty-three (33) of Clark's Las Vegas Townsite as per map of said Townsite on file and of record in the Office of the County Recorder of Clark County, Nevada, thence along the prolongation of the easterly line of said Block 33 N. 28°13' E. eighty (80) feet to the point of beginning; thence N. 61°47' W. 275.0 feet; thence N. 28°13' E. 300.0 feet; thence N.68°01'20" E. 117.15 feet; thence S.61°47' E. 200,0 feet; thence S. 28°13' W. 390.0 feet to the point of beginning, comprising a net area of 2.385 acres. TO HAVE AND TO HOLD the said premises, together with the appurtenances, from the date of the execution of this instrument, for the full term of fifty (50) years from the first day of September, 1935, next ensuing; the lesse to pay therefor the sum of Fifty ($50.00) Dollars, said sum being payable one ($1.00) Dollar on execution of this instrument, the receipt whereof is hereby acknowledged, and an additional one ($1.00) Dollar on or before the first of September of each year hereafter until the full sum of Fifty ($50.00) Dollars shall have been paid. PROVIDED FURTHER, that this lease shall terminate, at the option of the Lessor, upon the happening of any one or more of the following events: (1) Failure of the Lesse to construct a Memorial Building upon the said premises, of a value in excess of Fifteen Thousand ($15,000.00) Dollars, on or before the first day of January, 1936. (2) Upon dissolution of said Post of the American Legion, for any reason. (3) At any such time as the membership of said Las Vegas Post Number 8 of the American legion, Department of Nevada, shall not contain at least ten (10) members who are veterans of the World War. UPON THE TERMINATION OF THIS LEASE, each all and every part of the improvements constructed upon the said premises during the life of this lease, shall revert, together with the land, to the Lessor. IN WITNESS WHEREOF, the City of Las Vegas, a Municipal Corporation in the County of Clark, State of Nevada, Lessor, has caused this instrument to be executed by its Mayor thereunto duly authorized and the said Las Vegas Post Number 8, The American Legion, Department of Nevada, a corporation, Lessee, has caused this instrument to be executed by the chairman of its Board of Trustees and its finance Officer thereunto duly authorized. Vote on foregoing being, Commissioners, Down, Farnsworth, Marble and Ward and His Honor the Mayor Voting Aye., Noes, None Mr. Barry Dibble then appeared before the Board exhibiting his report an quadruplicate as required under contract dated July 11th, 1935 same appearing in good form and having been completed and accepted by the Board as a fulfilment of his contract with the City as con­sulting Engineer in his survey made of the local power and light situation, thereupon motion was made by, Commissioner Marble and Seconded by Commissioner Ward that Mr. Dibble be paid in full ($1150.00) the entire amount of said contract upon his presentation of claim on the regular prescribed city form. Vote being as follows; Commissioners, Down, Farnsworth, Marble and Ward and His His Honor the Mayor Voting Aye., Noes None.
