    Mr. Frank MeCully #2 (b) The Company will make no new connections for water service to any domestic, commercial or industrial establishment after December 1, 1951} unless application for such connection shall have been made to the Company prior to December 1, 1951}• No such application shall be accepted unless such establishment is com­pleted or under construction on December 1, 1951. Public hearing on this application which was set for January 22, 1952, has been Indefinitely deferred pending the setting of new date for hes.ring by the commission,If In view of a possible hearing before the commission you desire that we secure necessary authority and assemble materials so that the installation may be commenced as soon as possible I will, upon receipt of your approval, together with your check in the amount of $7^-90, request authority for con­struction of the water mains. Each of the above estimates include a contingency item of 10$ which is to cover any unforeseen increase in material and other costs. Our contract will provide that if actual costs of the work shall be less than your deposit, such excess amount will be refunded to you. In the event, however, that theactual cost should exceed the amount of your deposit, you will, upon receipt of bill, reimburse the Water Company for such additional cost. By actual cost is meant the cost of all material and supplies delivered to the job, the cost of all labor employed in connection with the installation of said water main, the cost of premiums on contractor's surety bond, Public Liability, Property Damage and Contractor's Contractural Liability Insurance, plus ten percent (10$) for supervision and overhead. The Contract will further provide for refund of 35$ of the revenues derived from the sale of water to consumers located within the subdivision above referred to taking service from the lines installed hereunder, during the ten year period following the completion of the installation or until your cost has been refunded whichever first occurs.
