    (C O P Y ) 4^ At Los Angelos - March 6, 1953 2180 Mr. R. M. Sutton; Referring to your letter of February 28th, your file 704-35, in connection with bills for water used in refrigeration service in Las Vegas: Your letter outlines the history of these refrigeration rates and, as you state, at the hearing October 9, 1952, the then existing rates were suspended* Thereafter a new tariff was filed pursuant to an order of the Commission and it was likewise suspended, this suspension still being in effect* Under the old tariff, as you indicate, certain refrigeration charges were paid by some of the smaller customers and if I understand your letter correctly, these customers are now refusing to pay the current water bills, insisting that the earlier payments under the old refrigeration rates be credited to their accounts* The Commission did not order any refund of sums collected under the old refrigeration rates and therefore these particular customers have no right to demand that the payments made tinder such old rates be credited on their current accounts. Demand should be made upon them for payment of current outstanding water charges other than charges for refrigeration* Mr. Bennett personally advises me that he does not think they will recognize these demands, but if they continue to refuse, consideration will then have to be given to notifying them that their water service will be shut off until the current bills are paid* (Sgd.) Maag - Las Vegas, Hev< For necessary attention* Particular attention is called to the fourth and fifth paragraphs in Mr. Rouse’s letter, in which he advises the Commission did not order any refund of sums collected under the old refrigeration rates and that the customers who paid such amounts have no right to demand such payments be credited to their current accounts. Mr. Rouse further advises demand should be made upon all customers for payment of outstanding current water charges, other than those for refrigeration, and the accounts followed up for collection* Please acknowledge receipt and understanding* L.
