AN ORDINANCE TO AMEND SECTION 17, CHAPTER 17, CODE OF LAS VEGAS, NEVADA, 1949, ALSO KNOWN AS SECTION 3, ORDINANCE NO. 3k9, BY PROVIDING FOR A PENALTY FOR LATE PAYMENT OF LICENSE FEES; PROVIDING OTHER MATTERS PROPERLY RELATED THERETO; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. SECTION 1. Chapter 17, Section 17, Code of Las Vegas, Nevada, 1949, also known as Section 3 Ordinance No. 349, is hereby amended to read as follows: Every license fee required under this chapter which is not paid within a period of fifteen days from the time the same becomes due and payable is hereby declared to be delinquent and the city clerk shall thereupon add to such license fee and collect, before issuing such license, a penalty of ten per cent of such license fee so delinquent (but not in any case less than fifty cents) in the event such license shall have been delinquent for less than fifteen (15) days. If such licence shall have been delinquent for more than fifteen (15) days, the said City Clerk shall add to such license fee and collect before issuing such license, a penalty of 25% of such license fee so delinquent. Such penalty may also be recovered in any civil action brought in the name of the city for the recovery of the amount of license tax imposed by this chapter; provided, however, that the city clerk during each current quarter, at least ten days before the next succeeding quarter, shall deposit in the United States Post Office at Las Vegas, Nevada, postage prepaid thereon, a written or printed notice directed to each person appearing upon the license tax roll for the current quarter calling attention to the fact that the license fee for the next succeeding quarter will be due at the time provided in this chapter and of the amount thereof, if readily ascertainable, and that the penalty herein provided will be exacted unless paid within the time required by this chapter. Proof of actual receipt of any such notice shall be in no case required. SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. Any person failing to pay such penalties provided in this ordinance shall be guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than $500.00 and/or six (6) months in jail, or by any combination of such fine and imprisonment. SECTION 4. This ordinance shall be in full force and effect upon its final reading and adoption, and final publication as in the next section provided. SECTION 5. The City Clerk and Clerk of the Board of Commissioners of the City of Las Vegas, shall cause this ordinance to be published once a week for two successive weeks immediately following its first reading and adoption, in the Las Vegas Review Journal, a daily newspaper published in the City of Las Vegas.
