Bennett I am preparing a recommendation to Mr. Stoddard for Mr. Reinhardt’s signature, covering the construction of 126 LF of 6* oast iron water main to replace 110 LF existing 6s cast iron water main, located on property of Mr. w. j. Moore, Jr., in Lot 1 Block 5, Desert Park #2, Las Vegas, Nevada. Pending Mr. Stoddard’s approval, will you please prepare an Agreement with Mr. w. J. Moore, Jr., whose address Is 600 Fremont Street, Las Vegas, Nevada, which should provide as follows: 1. That Mr. V?. J, Moore, Jr., will provide an easement described as follows: The Northerly 10 feet of Lot 1 Block 5 and that portion of the Westerly 10 feet of Lot 1 Block 5* extending from the Northwesterly corner of said lot to a point 30 feet Southerly thereof, all in Desert Park #2, as per map recorded in Book 3» Page 59 of Plats Clark County, Nevada records. 2. Mr. Moore has agreed to pay 1/3 of the cost of construct­ing a new line to replace existing line described above and the Agreement should therefore provide that Mr. Moore will deposit with the Water Company, an amount of #310.00 which is 1/3 the estimated cost of constructing a new line. 3. The Agreement should provide that Mr. Moore will agree that the existing line replaced may be retired In place and not removed from the property after new line l’s constructed without the benefit of any indemnification provisions in the Agreement. 4. While Mr. Moore has said he will pay 1/3 of the cost if present line Is replaced In 30 days, I believe that he would agree to a 30 day period from the date he signs this Agreement.
