Reinhardt) m 3. « 54 Supplementing my letter of August 27th, I enclose photostatic copy of "Examination of Accounts of Las Vegas Land and Water Company and Determination of Pinal Purchase Price Per Agreement as of June 30, 1954", submitted to the Directors of the Las Vegas Valley Water District by their accounting firm. 1 The report on page 5 states that the District should receive at the close of escrow $157#771.25# hut does not specifically state in the body of the report that we should receive our $18,245.29. Possibly that information is contained In some of the exhibits attached to the report. However, as I have heretofore advised you, it has been agreed that we are to receive the sum above mentioned. I draw your attention to Article X of the original Escrow Instructions of June 21, 1954, which provides that payments made by the Bank to the Water Company should be made by cashier's check, ete. May I not suggest that you write direct to the First National Bank of Nevada, Las Vegas, Nevada, attention Mr. C. D. Brown, Trust Officer, advising him that If and when he has received the necessary instructions for the distribution of the balance of the Purchase Price Adjustment Fund, that he send the Bank's check direct to Omaha, You can advise him with respect to the payee of the check as I am assuming it will not be necessary to handle this check as was handled the original check referred to in Mr, Burri's B-424 of July 1st, copy of which you received. As a matter of fact, Mr. Maag will not be in Las Vegas when this transaction is closed, and there will be no one out there to endorse the check and deposit It to the account of either the Water Company or the Railroad. We had originally been giving consideration to deducting from the respective balances to the Water District and the Water Company the amount of escrow fees, title fees, recording charges, etc, but we have received today a bill from the Bank covering those items, which is being checked
