    1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 1 6 17 1|8 19 20 21 22 23 24 25 26 THIS AGREEMENT, made this _______ day of __________, 1954, by LAS VEGAS LAND AND WATER COMPANY, a Nevada corporation (hereinaf­ter called “Water Company"), and LAS VEGAS VALLEY WATER DISTRICT, a public corporation of the State of Nevada (hereinafter called "Dis­trict"), WITNESSETH i Recitals Agreement dated June 1, 1953# between the Water Company, Los Angeles & Salt Lake Railroad Company, Union Pacific Railroad Com­pany and the District provides for the sale and conveyance to the District of the Las Vegas water distribution system of the Water Com­pany at a time therein designated as the "sale date". Section 9 of said agreement provides in part as follows: "At the present time there exists a controversy be­tween the Water Company and certain customers concerning the applicable and reasonable rates to charge for water furnished for air-conditioning, refrigeration, ice-mak­ing and other similar equipment under the provisions of Item 21, found on original sheet No. 3 of the Tariff of the Water Company on file with the Public Service Com­mission of the State of Nevada, covering Cooling Water for Refrigeration Machines, and proposed Item 21, found on first revised sheet No. 3 ^ said Tariff, covering cooling water for air-conditioning, refrigeration, ice machines and other similar equipment, which proposed Tariff was suspended by the order of the said Public Service Commission. Public hearing with respect to both of said Tariff items has been held and the matter submit­ted to the Commission in I. & S. Docket 142 and Case No. 1221. It is agreed that there shall not be assigned to the District on the sale date or added to the purchase price any amounts due the Water Company from customers for service furnished under either of said Tariff items or any Tariff item for such service prescribed by the Commission as a result of the hearing above mentioned unless the District shall consent thereto in said es­crow," Pursuant to the decision of the Public Service Commission of the State of Nevada in I & S Docket No. I4g and Case No. 1221 1 .
