BMI agrees to deliver water In such quantities as the Water District may demand, not to exceed five million (5,000,000) gallons of water per day or to exceed one billion, eight hundred twenty-five million (1,825*000,000) gallons per calendar year, provided that when the Water District shall at its own expense Install pumps and other facilities required to increase the delivery capacity of said Water Paoilities toy thirteen million, seven hundred and fifty thousand (13,750,000) gallons per day, upon and after the completion thereof said Water District may demand not to exceed thirteen million, seven hundred and fifty thousand (13,750,000) gallons of water per day or to exceed five billion, eighteen million, seven hundred and fifty thousand (5*018,750,000) gallons of water per calendar year. The Water District shall not obtain, under this contract or otherwise, any right to the delivery of any excess quantities of water, and the Water District hereby expressly waives, tinder this contract or otherwise, any right or claim of right to the delivery of any excess quantities of water. 8.
