Cozy 43 Sierra Street Reno, Nevada In connection with Senate Bill 150 amending the public utility law of the State of Nevada. I think the bill as a whole is very desirable but I would like, if possible, to have the amendment on page 6 modified. As you know, the Las Vegas Land and Water Company is negotiating for the sale of its facilities to the las Vegas Valley Water District, and although I do not believe we would have any difficulty securing the consent of the Nevada Public Service Commission to the transfer, I would rather not have to go through the Commission if we can avoid it. X would like the language on page 6, lines 11 to IT# amended to read as followst ”A certificate of public convenience issued to a public utility may be transferred to a purchaser of all the public utility assets of the utility. The purchaser shall first furnish such evidence of its corporate character and of its franchises or permits as may be required by the Commission, and the Commission shall have the power, after hearing, to approve or refuse approval of the transfer, but shall not otherwise alter, amend or abridge the certificate, provided however, that the consent of the Com­mission shall not be required in connection with such transfer by a public utility to a water district or other public agency existing under the laws of the State of Nevada.* The proviso is, of course, the main thing but you will note I have inserted in line 12 the words "of all the public utility assets of the utility. The reason for this is that the Las Vegas Land and Water Company, inaddition to owning certain public facilities, owns other assets which are not in­volved in our negotiation with the Las Vegas Valley Water District* Possibly the suggested insert is not material as the whole Act relates to public utilities but if it can be included and if the proviso can be added, I think the bill will be improved as far as the Las Vegas Land and Water Company is concerned. I have no objection to your telling Senator Murray the reason for the amendment and X think you can tell him that this proposed transfer is probably the only one which will come up and there would seem to be no reason for the Commission to take over the Jurisdiction of the transfer of public utility assets to
