GENERAL PROVISIONS A. Payments for the service furnished to the service location shall be^made monthly upon submission of properly certified invoices. Invoices to be billed to Officer-in-Charge of activity receiving service, but submitted to Public Works Office (Utilities Section), U.S. Naval Base Los Angeles, Naval Station, Long Beach 2, California, for certification and further transmittal to the activity concerned, B. Public voucher to be prepared and payment to be made by 60957. C. Such invoices shall contain statements of the meter readings at the beginning of the month, monthly consumption, and such other pertinent data as shall be required by the Government, D. All bills for service furnished hereunder shall be paid by the Government without penalty or interest. Section II - CONTRACTOR*S FACILITIES A. The Contractor, at its expense, shall furnish, install, operate, maintain, retain title to and be responsible for all loss of or damage to all facilities . required to furnish the service provided for herein. The Contractor will be allowed access to its facilities on Government premises at suitable times and it shall, at its expense, remove them and restore the premises to original condition within a reasonable time after termination of this contract. Sec-fa ion I - PAYMENTS Section III - CHANGE OF RATE SCHEDULES AND RATES A. The Government may upon request, in accordance with the Contractor's applicable rules and regulations, take service under any available rate schedule of the Contractor. B. Service furnished under this contract shall be subject to regulation in the manner and to the extent prescribed by law by any federal, state or local regulatory commission, having jurisdiction. If during the term of this contract the public regulatory commission having jurisdiction receives for file in authorized manner rates that are different from those stipulated herein for like conditions of service the Contractor agrees to continue the prescribed service and the Government agrees to pay for such service at the different rates from and after the effective date of such rates. Section IV - OFFICIALS NOT TO BENEFIT A, No Member of or Delegate to Congress or Resident Commissioner shall he ^ admitted to any share or part of this contract or to any benefit that may arise therefrom, but this provision shall not be construed to extend to this contract if made with a corporation for its general benefit. Section V - COVENANT AGAINST CONTINGENT FEES A« The Contractor warrants that he has not employed or retained any person or selling agency to solicit or secure this contract upon an agreement or understandin for a commission, percentage, brokerage, or contingent fee. For breach of warranty the Government shall have the right to annul this contract without liability or, in its discretion, to deduct from'.ihe contract price or consideration the amount of such commission, percemage, brokerage, or contingent fee This warranty shall not apply to commissions payable by Contractor to his bona fide, reg’ila** employees, or to bona fide established commercial or selling agencies maintained by the Contractor for the purpose of securing business.
