Bennett Will you please prepare usual form of Refund Agreement with Pioneer Title Insurance and Trust Company, whose address is 113 South Fourth Street, Las Vegas, Nevada, acting as Trustee for a group of individuals operating as Sunrise Association, covering construction of approximately ?00 LF of 6* cast Iron water mains and 6 LF of 6* fire hydrant connection to serve Block 1 of Sunrise Association Stocks Subdivision No. 1, Las Vegas, Nevada, in location described as follows s A 6* cast Iron water main commencing at a connection with existing 6® cast iron water main on the north side of Ogden Avenue at a point approximately 100 feet westerly of the west line of Twenty-first Street, thence southerly across Ogden Avenue a distance of approximately 50 feet to a point approximately 101 feet westerly of the west line of Twenty-first Street, thence southerly approximately along center line of easement extending from Ogden Avenue to Sunrise Avenue between Twenty-first Street and Cervantes Street a distance of approximately 650 feet to a connection with an existing 6® cast iron water main located on the north side of Sunrise Avenue at a point approximately 101 feet westerly of the west line of Twenty-first Street and 10 feet southerly of the north line of Sunrise Avenue, point of ending; also approximately 6 LF of 6* fire hydrant connection to above described pipe line on the north side of Sunrise Avenue. SUBDIVIDES AGREES: 1. Upon execution of Agreement to deposit the sum of |2,680* 2. To locate said water mains and fire hydrant connection. 3. To furnish easements where necessary together with title policies required. COMPANY AGREES: 1. Upon execution of Agreement and receipt of said deposit, necessary easements and title policies to proceed with construction of said water mains and fire hydrant connection. 2. To pay to the Subdivider, at quarterly intervals, 35$ of the" revenue received by it from consumers located within Block 1 of Sunrise Association Stocks Subdivision No. 1 and taking direct service from water mains constructed hereunder for a period of ten (10) years from date of completion of said installation or until Subdivider has been repaid the actual cost advanced by him (exclusive of the cost of constructing said fire hydrant connection) whichever first occurs.
