Maag, Acting General Manager Las Vegas Land and Water Company Las Vegas, Nevada Dear Mr. Maag: In regard to the territory served water by Theodore Michelas in the Meadows Addition, Las Vegas, Nevada you are correct in that the Michelas Certificate of Public Convenience and Necessity covers Blocks hf 12, 13, 1^, 15 and 16 specifically. Our records show no other certificate or amendments to exist. The contiguous area in the Meadows Addition was not specifically included in the Las Vegas Land and Water Company Certificate either. Section 36£ of the Nevada Public Service Commission Law provides that M.............................. nothing herein shall be construed as requiring a public utility to secure such certificate for any extension within any town or city within which it shall theretofore have lawfully commenced operations or for an extension into territory either within or without the city or town contiguous to its .............. plant or system and not then served by a public utility of like character". Under this provision of the act, the Las Vegas Land and Water Company has expanded into the contiguous areas as has Michelas in a minor way. Service in overlapping contiguous areas should be provided by the company whose facilities are most ready and able to serve. In case of controversy the matter may always be appealed to this Commission for hearing. We hope this review helps clarify your problem.
