C* McPeck is President* over a Las Vegas Land and Water Co, pipe lin e and easement loo&tloa in the Northerly 10* o f Lot M* Park Place Addition* Las Vegas* Nevada* I am now in receipt o f a nap prepared by Mr* Karston f • Brohken* Consulting Engineer* dated June 2h* 1953# which was prepared at my request and which shows that the bn cast iron water main over which the Valley Enterprises* Inc* have constructed two buildings* lie s within the 10* easement along the North lin e of Lot 1» In accordance with my tinderstanding with Mr* McPeck* President o f Valley Enterprises* Inc** he w ill provide a substitute easement fo r a new pipe lin e to be constructed across his property at a location where i t w ill not in te rfe re with existing buildings, and w ill bear the expense o f constructing a substitute pipe lin e therein* W ill you pleaae prepare an Agreement with Mr. McPeck, wherein he would provide the substitute easement and pay fo r the construction o f a substitute lin e to replace the portion o f the Water Company*s fc* lin e now located under buildings constructed by him* I believe this Agreement should contain the follow ing provisions § 1* Valley Enterprises to furnish the Mater Company with & 10* easement* 2« fo deposit the amount o f 1970*00* as the estimated cost o f constructing the substitute pipe lin e . I f the actual cost o f the work Is less than the amount deposited* the differen ce w ill be refunded to him or i f the cost of work is in excess of the estimated amount* he w ill pay the differen ce upon demand* % It new easement is furnished fo r the substitute lin e * the Water Company would agree to abandon a portion of the present easement and pipe lin e along the northerly 10* o f Lot I in return fo r the granting o f the new easement and payment fo r construction o f a substitute pipe lin e . I am sending you herewith two copies o f an easement covering the location on property o f Valley Enterprises* Inc** in which substitute lin e w ill be constructed* L* H* Knag
