I Kindly he referred to your letter March 22nd, enclosing draft of form of contract to he adopted hy the Railroad Company to cover sale of water to industrial lessees at Las Vegas. In Section 1, you have provided that " . .such surplus water as the Railroad may have available at Las Vegas beyond its needs and requirements in an amount not exceeding cubic feet per day, . • . *. Inasmuch as some characterof industries will naturally use more water than others, and it would be neces­sary for us to estimate the requirements of each industry for the purpose of supplying this information in Section 1 of the agree­ment, I wonder if we could not exclude the daily limitation? If this could be done, it would greatly simplify the matter. However, perhaps you have some good reason for including this daily limita­tion. Also, in Section 1, the phrase '•with minimum charge of $2,50 per month" has, I believe, not been shown properly. This should follow the expression "and 10 cents per 100 cubio ft. for all water furnished in excess of 800 cubic ft.*. Second paragraph under Seotion 2 provides that meter reading shall be taken by the Railroad Company at the expense of the user. Do you not think that this can properly be eliminated? I am inclined to the opinion that water users would object to this particular provision, and furthermore, I believe we Can consider that the rate charged for water is sufficient to take care of any expense incident to sending an employe out to take meter readings. I am returning herewith all copies of the draft of agree­ment which you prepared, and if you agree with my comments, shall be pleased if you will make the necessary changes. K-257 cia.B. MAR^71929 F.
