B — ^ e g y n t . , « d Awunt of water The original filing map covers the Cottonwood Springe pipe line to Sloan. It was prepared in October 1906 and was approved by the Board of Directors on the 8th day of January 1907. However, no record is available to show that this nun was filed. £*? a§?F?ved J * ™ « r y 1903 by the Secretary of"the Interior! This filing map is known as No. 1767 and a tracing was made for A revised right of way map was filed ~*T September 7, 1907 3, record purposes under date of April 21, 1913. A revision of Eight of Way Hap NO, 1767 was prepared in June 1924 and assigned Drawing NO, 30545. and is titled ’’Filing Map showing Location of Cottonwood Springs Pipe Line." It does not include Sloan pipe line, which was abandoned at that time. This filing map was approved April 10, 1925. (See pages 3 and 9 of report) Title to the 80 acres owned by the Railroad Company on which is located Cottonwood Springs, carries with it the right to develop water thereon. However, on the 23rd day of October 1924 Mr. F. R. McNamee filed the following affidavit which was accepted by the Department of the Interior: That this affiant is familiar with the laws of the State of Nevada pertaining to water rights: that prior to the first day of March, 1905, the manner of acquiring a right to water in the State of Nevada was by actual appropriation and application to a beneficial use and not otherwise; that subsequent to March 1, 1905, but not before, lavs have existed in the State of Nevada which prescribe the mode of acquiring rights to the public waters within the State, and vest certain regulatory powers of and concerning such waters in a state officer of said State, to-wit, the State Engineer, hut that such water laws and regulatory powers vested in the State Engineer were and are subject and subordinate to the vested rights to water acquired prior thereto, and do not affect in any manner the rights acquired by ownership, development and application to a beneficial use of the water before March 1, 1905; 1-
