' * upon the total eost of the work performed by Union Pacific un­der this section 3* The right t© construct said new pipe lines referred to in this Section 3 shall include the right fee construct pumps, reives, connections end appurtenance** Section 4 * In the event the District and Union Pacif­ic are able to agree upon the type and nature of the pipelines and pumping stations t© he constructed by the Union Pacific pur­suant to the provisions of Section 3 hereof, said new pipelines, appurtenances and pumping station shall be constructed, and said pipe lines shown by broken black and red line on inhibit nk* shall be removed, under the Joint direction of the District and Union Pacific pursuant to a contract to be entered into between the Union Pacific and a contractor after bids have been obtained therefor* In the event the Union Pacific and District shall be unable to agree upon the type and nature of said new pipe lines and pumping station, Union Pacific shall nevertheless have the right to construct said facilities as provided in Section 3 and to remove said pipe lines shown by broken black and red lines on Exhibit *4* pursuant to a contract to be entered into between the Union Pacific and & contractor after bid© have been obtained therefor* In either event the contract price thereof plus 10$ for supervision shall be considered a© the cost to Union Pacif- .1c of constructing ©aid new pip® line facilities and pumping station and removing said existing pipe lines* Section 5.
