Commissioner Fountain seconded the motion, and the question being upon its passage, the roll was called with the following result: Those voting aye: Commissioners Bunker, Fountain, Sharp, Whipple and Mayor Baker. Those voting nay: none. The presiding officer thereupon declared that all Commissioners having voted in favor thereof, said motion was carried and said ordinance was duly passed and adopted. Commissioner Sharp moved this ordinance be numbered 661. Motion seconded by Commissioner Fountain and carried by the following vote: Commissioners Bunker, Fountain, Sharp, Whipple and Mayor Baker voting aye; noes, none. Commissioner Sharp moved the following resolution directing that a public hearing on the creation of Assessment District No. 100-36 be held September 21, 1955, be adopted: WHEREAS, the Board of Commissioners of the City of Las Vegas, have taken steps to create certain public improvements all as provided in Ordinance No. 661, passed, adopted and approved this 8th day of September, 1955, WHEREAS, said Ordinance No. 661 discloses the intention and determination of said Board of Commissioners to create said district and construct said improvements by special assessment made according to benefits; and WHEREAS, said Ordinance No. 661 provides a time certain for hearing pro­tests against said proposed improvements and directing that notice thereof be given, such time of the protest hearing being 8:00 P.M., on the 21st day of September, 1955, NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Las Vegas at a recessed regular meeting thereof held on the 8th day of September, 1955, that the City Clerk and Clerk of the Board of Commissioners be and she is hereby directed to publish notice of said hearing once a week for two successive weeks in the Las Vegas Review Journal, a daily newspaper published in the City of Las Vegas; and BE IT FURTHER RESOLVED that the City Clerk and Clerk of the Board of Commissioners be and she hereby is directed to post notice of said hearing in at least three public places near the site of the proposed work; and BE IT FURTHER RESOLVED that said notice shall be in substantially the form attached to this Resolution and made a part hereof. ADOPTED AND APPROVED this 8th day of September, 1955. Motion seconded by Commissioner Fountain and carried by the following vote: Commissioners Bunker, Fountain, Sharp, Whipple and His Honor voting aye; noes, none. An ordinance entitled: AN ORDINANCE TO PROVIDE FOR MAKING EXCAVATIONS IN THE PUBLIC STREETS, ALLEYS, AND EASEMENTS; PROVIDING FOR THE ISSUANCE OF PERMITS THEREFORE; PROVIDING FOR REPLACEMENT AND REPAIR OF STREETS AFTER EXCAVATIONS; PROVIDING PENALTIES FOR THE VIOLATION HEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING OTHER MATTERS PROPERLY RELATED HERETO, having been reported on favorably by Commissioners Fountain and Sharp was read in full to the Board at this time. Commissioner Sharp moved the above entitled Ordinance No. 662 be adopted. Motion seconded by Commissioner Fountain and carried by the following vote: Commissioners Bunker, Fountain, Sharp, Whipple and His Honor voting aye; noes, none. City Manager A. H. Kennedy requested that the Mayor be authorized to sign a request for right of entry on the Old Ranch property the City is purchasing from the Las Vegas Land and Water Company. Thereafter Commissioner Bunker moved this request be approved and the Mayor authorized to sign the request for right of entry. Motion seconded by Commissioner Sharp and carried by the following vote: Commissioners Bunker, Fountain, Sharp, Whipple and His Honor voting aye; noes, none. A. H. Kennedy, City Manager, presented reports from the License Department and the Police Department on the operation of the Eldorado Arcade indicating that they have been allowing juveniles to play slot machines, and requested that the licensee be instructed to appear before the Board to show cause why the license should not be revoked. Thereafter Commissioner Sharp moved that W. Howard Adams, licensee of the Eldorado Arcade, 4 Fremont Street, be instructed to appear before the Commission at the next regular meeting on September 21, 1955 to show cause why his license should not be revoked. Motion seconded by Commissioner Fountain and carried by the following vote: Commissioners Bunker, Fountain, Sharp, Whipple and His Honor voting aye; noes, none. 9-8-55 ASSESSMENT DISTRICT No. 100-36 Resolution on Public Hearing ORDINANCE NO. 662 Excavation Permits OLD RANCH PROPERTY Request for Right of Entry ELDORADO ARCADE To Appear On License Revocation
