At any time after the escrow provided in 4 Section T shall have been opened Water Company agrees, at the 5 request of the District, to request the consent of the Board of 6 City Commissioners of the said City of Las Vegas to assign all 7 rights and privileges under said permit to the District, and 8 when said consent shall have been obtained, to assign by appro— 9 prlate document and deliver to the District such assignment if 10 required by the District. In the event that the District shall 11 not request the Water Company to assign said permit, the Water 12 Company agrees that after the sale date it will never exercise 13 or claim the right to exercise any right under said permit for 14 the purpose of serving customers in the City of Las Vegas with 15 water as a public utility. 16 (j) All of the right, title and interest owned or 17 claimed on the sale date by the First Parties in and to easements 18 licenses, leases, contracts and permits for the construction, 19 maintenance, operation, and renewal under, along, upon or across 20 the lands of others for the water distribution facilities re- 21 ferred to in subparagraphs (f) and (g) of this Section 1. 22 in the event any of the said distribution facilities referred 23 to in the preceding sentence have been or are being constructed 24 upon, along or across lands owned by the First Parties, or any 25 of them, the party owning said lands shall grant to the District 26 upon the sale date easements across said lands 7-1/2 feet on each 27 28 10.
