RE: Retirement of 70,000 gallon steel water tank at Arden, Nevada. Las Vegas, Nevada August 2, 1963 Mr. E. C. Renwick: Replying to your letter of July 15, 1963, with which you forwarded five documents loaned from the Accounting Department and delivered to you by Mr. Groome in connection with the retirement of a 70,000 gallon steel water tank at Arden, Nevada, I return herewith the five documents referred to by Mr. Groome. It appears from the enclosures that two sources of water are used for servicing the Arden area. The first source is known as "Cottonwood Springs" located on Cottonwood Ranch, which was acquired by theRailroad in May, 1901, and on which water had been placed to beneficial use by predecessors in interest of the Railroad. The first comprehensive water law in Nevada became effective on March 1, 1905, and the Railroad, therefore, had a vested right to all of the water rising and flowing from Cottonwood Springs without the necessity of any application or permit from the State authorities. The second water source is known as "Upper Cottonwood Springs" and was originally covered by Application No. 7072 made by Nevada Lime and Rock Company on May 29, 1924. Rights under this application were assigned to the Railroad on January 2, 1926. Permission to appropriate water under Application No. 7072 was approved by the State Engineer January 21, 1926. Proof of labor was filed on February 24, 1927, and proof of completion of work was filed December 8, 1927. Thereafter Application No. 8819 was filed on January 23, 1929, for permission to change the point of diversion of water and use under Permit No. 7072. Application No. 8819 was approved by the State Engineer November 18, 1929, with the priority dating back to May 29, 1924, being the date of filing of Application No. 7072. Subsequently, proof of commencement of work and proof of completion of work, and proof of application of water to beneficial use was filed with the State Engineer. Application No. 8819 was recorded February 26, 1932, in Book 1, page 78 of Water Appropriations, Clark County, Nevada, and is identified as Deed Audit No. 4033, an undated copy of which was forwarded to me with your letter of May 14, 1963.
