AN ORDINANCE TO AMEND CHAPTER 31, CODE OF LAS VEGAS, NEVADA, 1949, ALSO KNOWN AS ORDINANCE NO. 377: BY DEFINING PRIVATE DETECTIVES AND SPECIAL INVESTIGATORS AS SPECIAL POLICE OFFICERS; BY REQUIRING AN INVESTIGATION OF ALL PRIVATE DETECTIVES AND SPECIAL INVESTIGATORS; PROVIDING OTHER MATTERS PROP- ERLY RELATED THERETO; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; AND REPEALING AIL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. WHEREAS, there are many private detectives and special investigators operating in the City of Las Vegas without registering with the Chief of Police; arid. WHEREAS, the present ordinances do not adequately protect the residents of the City of Las Vegas, NOW, THEREFORE, THE BOARD OF CITY COMMISSIONERS OF THE CITY OF LAS VEGAS DO ORDAIN AS FOLLOWS: SECTION 1. Chapter 31, Section 1, Code of Las Vegas, Nevada, 1949, also known as Section 1, Ordinance No. 377, is hereby amended to read as follows: Section 1. Definitions. For the purposes of this chapter, the following words and phrases are defined, and shall be construed as hereinafter set out, unless it shall be apparent from the context that they have a different meaning. (a) Official police officer's bade. "Official Police officer's badge" shall mean a badge of the size, type and design as used by the regular police force of the city. (b) Private patrol. "Private Patrol" shall mean any person carrying on the business or occupation of night watchman, night watch service, private policeman or any other occupation, the purpose of which is to afford additional police or fire protection for hire or reward. (c) Special police officer's badge. "Special police officer's badge" shall mean a badge of the size, type and design as designated by the chief of police of the city for the use of persons commissioned by the chief of police to act as special police officers as hereinafter provided. Such badge shall have enameled on the fact thereof "Special" in addition to any other words or device and shall so differ in shape and design from the official police officers' badge as to be, when displayed or worn, readily distinguishable therefrom. All such badges shall be consecutively numbered and the number shall appear on the face of each such badge. (d) Special police officer. "Special police officer" for the purpose of this ordinance, shall include any individual acting as a private detective, special investigator, peace officer, or member of a private patrol, club guard, bank guard, or an owner of a private patrol who actively engages in policing duties, night watchman, other than a regular police officer of the city. SECTION 2. Section 5, Chapter 31, Code of Las Vegas, Nevada, 1949, also known as Section 5, Ordinance No. 377, is hereby amended to read as follows: "Special police officer badges shall be issued by the chief of police and only to persons who have secured commissions as special police officers from the chief of police and who have paid all fees required therefor by this chapter or ordinances of the city, if so required; provided, however, no badges shall be required nor shall badges be issued to private detectives or special investigators. SECTION 3. Subparagraph (g), Section 6, Chapter 31, Code of Las Vegas, Nevada, 1949, also known as Section 6, Ordinance No. 377, is hereby amended to read as follows: (g) Cost of investigation of applicant. The chief of police shall also make a charge of fifteen dollars to cover the costs of investigation of any applicant for a commission as a special police officer, to to cover the costs of an investigation of an application for a permit to operate a business of private patrol; provided, however, such charge shall not be made for investigation of individual private detectives or special investigators. SECTION 4. The provisions of this ordinance are not intended in any way to repeal the provisions of Chapter 17, Section 12, Page 259, Code of Las Vegas, Nevada, 1949, governing the licensing and investigation of persons conducting a private detective business, but are intended and do apply to employees thereof. SECTION 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6. Any violation of the provisions of this Ordinance shall constitute a misdemeanor and shall, be punished by a fine of not more than $500.00 or by imprisonment in the City Jail for not more than six (6) months, or by both such fine and imprisonment. SECTION 7. This ordinance shall be in full force and effect upon its final reading and adoption, and final publication as in the next section provided. SECTION 8. The City Clerk and Clerk of the Board of Commissioners of the City of Las Vegas shall cause this ordinance to be published once a week for two successive weeks immediately followings its first reading and adoption, in the Las Vegas Review Journal, a daily newspaper published in the City of Las Vegas.
