EMERGENCY ORDINANCE NO. 459 AN EMERGENCY ORDINANCE TO AMEND SECTION X OF ORDINANCE NO. 378, AS AMENDED BY ORDINANCES NO. 381 AND 382 OF THE CITY OF LAS VEGAS ENTITLED: "AN ORDINANCE OF THE COMMISSION OF THE CITY OF LAS VEGAS CREATING ELEVEN (II) DISTRICTS, REGULATING AND RESTRICTING; THE USE OF LAND, THE LOCATION AND USE OF BUILDINGS AND OTHER STRUCTURES; THE HEIGHTS AND BULK OF BUILDINGS AND OTHER STRUCTURES; THE PROVISIONS OF OPEN SPACES FOR LIGHT AND AIR; THE INTENSITY OF SUCH USES AND THE DENSITY OF POPULATION; ESTABLISHING BUILDING SETBACK LINES; ADOPTING A MAP OF SUCH DISTRICTS DEFINING THE TERMS USED HEREIN; PROVIDING FOR THE ADJUSTMENT AND AMENDMENT THEREOF; REQUIRING THAT CERTAIN PERMITS SHALL BE SECURED FOR SUCH BUILDINGS, STRUCTURES AND IMPROVEMENTS AND FOR THE USE THEREOF, AND OF LANDS; REQUIRING CERTAIN FEES; PROVIDING THEREOF, AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH," AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH." WHEREAS, the Board of City Commissioners of its own motion on April 25, 1951, determined to hold a public hearing on the question of a zone change of the NE¼ of Section 28, T 20 S, R 61 E, MDB&M, commonly known as the Zaugg Tract, and WHEREAS, the notice for the holding of such public hearing was duly given as required by law; and WHEREAS, the said public hearing on the contemplated zone change was held at the Council Chambers in the City Hall on Stewart Avenue, comer of North Fifth Street, in the City of Las Vegas, Nevada, on the 16th day of May, 1951, and persons who desired to be heard were heard at that time, and WHEREAS, a committee composed of the following persons: Robert E. Jones, J. David Hoggard, Rulon A. Earl, Maxwell Kelch, William Peccole, A.C. Grant, and Howard W. Cannon, on April 23, 1951, submitted a study of the facts and circumstances surrounding the afore contemplated zone change to the Board of City Commissioners, and WHEREAS, the Board of City Commissioners deem it to be in the public interest that the aforesaid zone changes be granted, NOW, THEREFORE, THE BOARD OF COMMISSIONERS OF THE CITY OF LAS VEGAS DOES ORDAIN AS FOLLOWS: Section 1. That the following described property be rezoned from an R-E (Residence Estates) to R-1 (One-family residence) Zone, to-wit: That area of the NE¼ of Section 28, T 20 S, R 61 E, MDB&M, commonly known as the Zaugg Tract, and being more particularly described as the E½ of the NE¼ Section 28, T 20 S, R 61 E, MDB&M, and being that area east of J Street and West of H Street, bounded on the north by- Harrison Street and on the South by Washington Street. Section 2. That a minimum building area restriction of 850 square feet, exclusive of car ports, garages, and other residential building appurtenances, be imposed in that certain R-E Zone (Residence Estates) particularly described as follows, to-wit: The E½ of the W½ of the NE¼ of Section 28, T20S, R61 E, MDB&M, and commonly described as that part of the Zaugg Tract lying between J Street and K Street, and bounded on the north by Harrison Street and on the south by Washington Street. Section 3. That a minimum building area restriction of 1,200 square feet exclusive of car ports, garages, and other residential building appurtenances, be imposed in that certain R-E Zone (Residence Estates) particularly described as follows, to-wit: The W½ of the W½ of the NE¼ of Section 28, T 20 S, R 61 E, MDB&M, and commonly described as that part of the Zaugg Tract lying between K Street and Highland Avenue, and bounded on the north by Harrison Street and on the south by Washington. Section 4. That all ordinances or resolutions, or parts thereof, in conflict with the provisions of this ordinance, are hereby repealed. This repealer shall not be construed to revive any ordinance, nor resolution, or part thereof, heretofore repealed.
