\ Water Supply - Fillmore* Los Angeles* February 8, 1923. Mr. A. Maguire: Referring to your letter of February 3rd in connection with the above subject, your file W-770, and returning herewith copy of resolution sent me with that letter: tt * »> resolution in question refers to the union taoiflo Railroad Company, further action will in any event have to be taken. Reference should of course be to Los Angelas & Salt Lake Railroad Company, the correct of this unit, cornorate name 3* fiud from the above there are several points which should properly be covered. They are as follows: (l) The term is not stated, (3) There is no statement as to the quality of the water to be furnished, I presume it is Intended that the water used generally by the city be furnished and probably it is unnecessary to specifically provide what.the quality of water shall be, I may say that under the resolution the city might furnish creek water or any other waters containing a high percentage of Impurities which would be unfit for boiler us©,* (3) The resolution gives the right to our company to construct pipe lines over lands owned by the city of Fillmore, It may be that the city does not own the lands used for street purposes, the public merely having a right of way for such pur** poses thereover. It would be desirable if an explicit provision on this point were included. As a matter of fact it would probably be better if the lines are to be constructed in or through any streets, that franchise rights be granted. (4) There is no provision permitting our company to check meter readings, (5) lor is there any provision as to the time for the making of payments, although it may be inferred that they are to be made monthly, (6) The city acting as a public utility in the furnishing of water, the public Utilities Commission may under the 1-
