AN ORDINANCE TO AMEND CHAPTER 24, SECTION 28, SUBPARAGRAPH B, PAGE 426, CODE OF LAS VEGAS, NEVADA, 1949, ALSO KNOWN AS SECTION 22, OF ORDINANCE NO. 378, BY PROVIDING THE PROCEDURE TO BE FOLLOWED IN INVESTIGATING APPLICATIONS FOR USE PERMITS; PROVIDING OTHER MATTERS PROPERLY RELATED THERETO; AND REPEALING ALL ORDIN- ANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. The Board of Commissioners of the City of Las Vegas do ordain as follows: SECTION 1. Chapter 24, Section 28, Subparagraph B, Code of Las Vegas, Nevada, 1949 at Page 426, also known as Ordinance No. 378, Section 22, is hereby amended to read as follows: B. The Planning Commission shall cause to be made by its own members, or by the Director of Planning, an investigation to determine that such use in the location specified will not be injurious to the public health, safety, or welfare, or detrimental to other properties or uses in the vicinity. The Director of Planning shall refer copies of the use permit to any governmental departments or agencies, quasi-public agencies or public utilities, when in his opinion, the safeguarding of the public health, safety, or welfare requires a study of the use requested and a report from the department or agency affected. All department or agency heads to whom the application is referred shall submit their reports and recommendations in writing regarding the effect of the requested use on the public health, safety, and welfare as it concerns their department or agency, to the Director of Planning within seven (7) days of the date of the referral of the application. SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. This ordinance shall be in full force and effect upon its final passage and publication as in the next section provided. SECTION 4. The City Clerk and Clerk of the Board of Commissioners of the City of Las Vegas shall cause this Ordinance to be published once a week for two successive weeks immediately following its first reading and adoption in the Las Vegas Sun, a daily newspaper published in the City of Las Vegas.
