^ RESOLVED, that the action of President and Assistant Secretary Rigdon in executing agreement, Contract Audit No. 10119, dated April 4, 1941, between Las Vegas hand and Water Company, called "Land Company", and Val Vita Pood Products, Inc., called "industry", providing for; 1. Conveyance to Land Company by Industry^of a parcel of land, located near intersection of North Brookhurst Avenue and Moore Avenue, in City of Fullerton, California; 2. Construction by Land Company of a warehouse building, containing approximately 120,800 square feet, of wood frame construction with corrugated iron sides and roof and concrete floor, at estimated cost of $145,000.00; 3. Sale by Land Company to Industry of said parcel of land and warehouse building; Industry agreeing to make payment, as follows; (a) Temporary down payment of 30% of estimated cost, less the amount contracted to be paid by Industry for preparation of plans and specifications; (b) In event total estimated cost shall exceed $145,000, Industry shall make additional down payment of an amount equal to such excess; (c) In event the actual cost shall exceed the total estimated cost, Industry shall make further down payment of an amount equal to such excess; (d) Balance of purchase price, including interest on deferred balance, shall be paid in equal monthly installments, commencing upon date of completion or date of occupancy, whichever occurs first, and final installment to be made not later than July 24, 1954; be, and the same is hereby, ratified, approved and confirmed.
