    \ Western Auto shall have option to renew lease for three successive terms of five years each, by giving Land Company written notice of intent to exercise prior to expiration of each term; rent to be redetermined at the end of first 5-year term and at the end of each 5-year period* if option exercised to renew; Western Auto to pay taxes upon leased premises, and all assess­ments for public improvements not chargeable to Capital Account; Land Company shall pay assessments for public improvements chargeable to Capital Account, and Western Auto agrees to pay five per cent (5%) per annum on amount so assessed; Land Company at its expense, shall arrange for construction of said buildings, tracks and other improvements, in accordance with plans attached as Exhibit to agreement; Western Auto to enter into agreement with Los Angeles and Salt Lake Railroad Company-Union Pacific Railroad Company for maintenance and operation of said spur track; agreement of Land Company to construct said building, tracks and improvements, Is conditioned upon understanding that proposed con­struction contract between The Ted R. Cooper Company, Inc0 and Land Company, (attached as Exhibit to said agreement) is satis­factory to parties of agreement; Western Auto to pay for water, gas, electricity and other utilities contracted for, and to main­tain premises, and shall indemnify Land Company from and against all claims, demands and causes of action from injury to or death of persons, or loss of or damage to property; Land Company, at Western Auto expense, to keep building insured,; in event of 7-
