Hamilton 0‘Melveny & Myers 433 South Spring Street Los Angeles 13* California Dear Mr. Hamilton* Rule 9 of the Rules and Regulations of the Water Department of the Las Vegas Land and Water Company,ef­fective September 1, 1952, which are on file with the Public Service Commission of Nevada, provides as fol­lows* "Rule 9, New Extensions - Whenever an application for water service is received which will require the Company to extend its water mains more than fifty feet, exclusive of the service pipe of each customer to be served, the applicant shall enter into a con­tract to advance sufficient money to cover the cost of making such extension. The a- mount advanced shall be refunded quarterly to the applicant advancing the same at the rate of 35# of the revenue received by the Company from customers whose service lines connect with such extension for a period of ten years from date of completion of such extension, or until the full amount of the advance has been refunded, whichever occurs first•" This is similar to previous rules except that the re­fund under previous rules was at the rate of 50# in­stead of 35# of the revenue received from customers.
