I knew Mr.Bracken had never received any authority to make contracts for either the Empire Construction Company or the Railroad Bompany. I told Mr.Green that in dealing with a corporation he should use a little judgment and before entering into a contract should satisfy himself that the party with whom he was negotiating had authority to act. He acknowledged this and said he usually did. While the license in the store was in the name of the Empire Construction Company, it often happens that a party purchasing a store from another operates under the license granted the former, and while the last license issued, and that which was in the store when Green made his alleged contract, was issued to the Empire Construction Company after the Railroad Company had assumed charge and operated the store and ranch for some time, it was not our fault. The county issues these licenses in the name of the party who has done business and sends them out to the Deputy Sheriff to deliver and collect fee, and if party does not make strenuous objection it has to stand. While I was there a new license came in the name of the Empire Construction Company and I refus­ed it, but the sheriff said he could not change it, as it was made up at Pioche. I insisted, however, that it be changed to read in the name of the San Pedro, los Angeles & Salt lake Railroad and that was finally done. Kuhn Mercantile Company, who purchased the business, are working under the license issued in the name of the Railroad Company, notwithstanding this Mr.Bracken should have seen that license
