SCHELLACK, being first duly sworn, deposes and says: That he is Foreman of the LAS VEGAS REVIEW JOURNAL, a daily newspaper, of general circulation, printed and published at Las Vegas, in the County of dark, State of Nevada, and that the attached was continuously published in said newspaper for a period of Two (2) insertions from February 5, 1956 to February 12, 1956 inclusive, being the issues of said newspaper for the following dates, to-wit: February 5, 12, 1956. That said newspaper was regularly issued and circulated on each of the dates above named. /s/ A.F. SCHELLACK Subscribed and sworn to before me this 13th day of February, 1956 /s/ NEOLA GIERHART NOTARY PUBLIC IN AND FOR CLARK COUNTY, NEVADA My Commission Expires April 14, 1957 ORDINANCE NO. 695 AN ORDINANCE AUTHORIZING CITY OFFICERS, INSPECTORS AND EMPLOYEES CHARGED WITH THE ENFORCEMENT OF CITY ORDINANCES TO PREPARE AND SERVE SUMMONS ON PERSONS CHARGED WITH VIOLATION OF CITY ORDINANCES, SUMMONS­ING THEM TO APPEAR IN COURT AT A TIME SPECIFIED TO ANSWER THE CHARGE AGAINST THEM; PROVIDING A PENALTY FOR FAILURE TO APPEAR AS SUMMONSED; AND PROVIDING OTHER MATTERS PROPERLY RELATED THERETO. The Board of Commissioners of the City of Las Vegas do ordain as follows: SECTION 1. Except when otherwise expressly directed by law or ordinance, upon any violation of any ordinance of the City of Las Vegas, the Fire Chief of the City of Las Vegas, his deputies and assistants; The Supervisor of Building and Safety, his deputies and assistants; The Health Department Director, his deputies and assistants; the deputy poundkeeps and assistant employed by the Clark County Humane Society; The Garbage Contractor and its officers and agents; and all other officers, inspectors and employees charged with the enforcement of city ordinances in lieu of arresting the person com­mitting the violation, may prepare, sign, and serve on the accused person a written summons to appear in the Municipal Court to answer such charge. Such summons shall be personally served on the person ac­cused. SECTION 2. The summons provided for in the preceding section shall be in substantially the following form: In the Municipal Court of the City of Las Vegas, County of Clark, State of Nevada SUMMONS City of Las Vegas, Nevada Plaintiff vs Defendant The State of Nevada to The Above Named Defendant You are hereby summoned to appear before the judge of the above entitled Court at the Courtroom thereof at 400 North 1st Street, Las Vegas, Nevada on ............. the ......day of...................., 195..., at the hour of..........o'clock ...M to answer a charge of .............................. in violation of Ordinance No...... or Code of Las Vegas, Nevada, Chapter......Section No........ Date of Offense______________ City of Las Vegas by__________________ (office or position of person issuing and serving summons) SECTION 3. The time specified in such summons for the accused to appear must be not less five (5) days after service, unless an earlier hearing is demanded by the accused. SECTION 4. Any person willfully failing to appear in Court as required by such summons is guilty of a misdemeanor, regardless of the disposition of the charge of which he is accused. SECTION 5. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION 6. This Ordinance shall be in full force and effect upon its final reading and adoption, and final publication as in the next section provided. SECTION 7. The City Clerk and Clerk of the Board of Commissioners of the City of Las Vegas shall cause this ordinance to be published once a week for two successive weeks Immediately following its first reading and adoption in the Las Vegas Review Journal, a daily newspaper published in the City of Las Vegas.
