D* 1843 a water main was in- •tallad by frontier Improvement Company in the South Fifth Street fr&ct and the Subdivides granted ue an easement 5-feet en each side of the common lot line be-tween Lote 3 and 4 of H o o k 3 , South Fifth Street Tract Mo. 1* frde easement was duly recorded in Book 53, Fage 547* of Seeds, Clark County Records* Subsequently,and without notification to the Water Company, the plat was amended so that there are only 2 blocks In the tract instead of 3 , and Slock 3 was changed to read “Slock 2“* The purchaser of Lot 4 has constructed an Auto Court, a portion of which encroaches on the pipe line easement* In view of the fact that the above mentioned agreement, C/A 10427, provides that the subdivide will furnish us an easement 5-feet on each side of the center line of pip# line so installed, assume that we could require the® to do so. However, to avoid litigation and oonsiderable expense, X have conferred with the parties concerned and the owners of Lot 4 agree to give us a 2 ft easement along the northerly edge of Lot 4, which is unoccupied by his building; and the Frontier Improvement Company will give us a 5 ft easement along the southerly edge of Lot 3. Will you kindly prepare 2 easements, one to cover a 2 ft etrip along the northerly edge of Lot 4, to be executed by Clarence C. Flory and his wife Mae Flory; and a 5 ft easement along the southerly edge of Lot 3, to be executed by Frontier Improvement Company* loth of these locations are In Slock 2, South Fifth Street Tract, as shown on plat recorded In Book 2, Page 72, Clark County Records.
