l 4 V required and used toy said grantee, its successors and assigns, is to toe used toy the grantor Valter James in such maimer and for such purposes as ho m y see fit, subject to the restriction that neither the grantor Valter James, his heirs, executors, administrators or assigns, nor the grantee, its successors or assigns, shall ever permit any other person ©r persons, company or corporation to acquire a right to any of the said water by user or prescription, and to that end the said grantor Valter James shall not permit any other person or persons, company or corporation to use any of said water except subordinate to and as tenant of said grantor; the use of said surplus water by said grantor Valter James and all persons, companies and corporations under him to toe at all times subject to and subordinate to the rights of eald grantee, its successor# and assigns, to the use of ffe# entire three hundred thousand gallons of water per twenty four hours whenever desired by said grantee, its successors and assigns* If at any time the flow of said springs is less than three hundred thousand gallons per twenty four hours there shall toe no liability against said grantors for such deficiency, tout so long as there shall toe a flow of three hundred thousand gallons per twenty four hours from said springs said grantee. Its successors and assigns, shall toe entitled to that amount* Said grantee shall not at any timo sell or rent any of said three hundred thousand gallons of water for use of inhabitants within five miles of Black Bock station except to occupants upon the lands now or that may hereafter toe conveyed to it toy the said grantors, and to occupants upon lands now owned or hereafter acquired toy the grantee along its m i n line and side tracks at said station, and to its employes* W I T U S S the hands of said grantors this 17th day of March, A* 33* one thousand nine hundred and five* z
