The Subdivider agrees: 1 # To advance and pay to the Company at the time of the execution of this agreement the sum of Thirty-one Hundred (#3100.00) Dollars. 2. At Subdivider*s sole cost and expense to survey and accurately stake upon the ground the line along which said water main is to be laid. 3. Furnish to the Company a perpetual right of way and easement along a strip five feet in width, to lay, operate, maintain and renew the water main along the line where same is to be laid in said Block 3, which easement shall be duly executed by the owners of the land over which the main is to be laid. ARTICLE II. The Company agrees: 1. Upon the execution of this agreement and the payment of the sum of #3100*00, specified in paragraph 1 of Article I hereof, and upon delivery of said executed easement specified in paragraph 3 of Article I hereof, to order the necessary pipe, fittings and other materials necessary for the making of such extension, and upon the arrival at Las Vegas of the pipe and materials aforesaid, to proceed with the installation of said water main along the line so staked upon the ground by the Subdivider, and to complete the said installation with reasonable diligence.
