The Nevada P u b lic U t i l i t i e s Act p rovid es that the Commission s h a ll have power to pass upon the p ro p rie ty o f such r a t e , fa r e , charge, c la s s if ic a t io n , r e g u la t io n o r p ra c tic e o f a p u b lic u t i l i t y . (S ec tio n 6113, Nevada Compiled L aw s). As you know, the P u b lic Service Commission o f Utah, in Case No. 3372, "In the M atter o f the A p p lic a tio n o f Mountain Fuel Supply Company fo r re­s t r ic t io n o f gas se rv ic e * handed down i t s Report, F indings and O rder, dated A p r il 2, 1949, in which i t provided , among other th in gs, that the Mountain Fuel Supply Company should "not accept any a p p lic a tio n s o r fu rn is h any a d d it io n a l gas fo r new or a d d it io n a l uses except as provided in Section (g ) h e re in ". (S ec tio n ( g ) r e fe r r e d to s p e c ia l h eatin g p r iv ile g e s f o r physi­c ia n s 1 o f f i c e s e t c . ) . This d e c isio n was apparently based on the gen eral-pow ers o f the P u b lic Service Com­m ission above r e fe r r e d to . In p a ssin g , and f o r reasons which I w i l l r e f e r to l a t e r in th is l e t t e r , the Utah Commission drew a tte n tio n to Section 76-3-1 o f the Utah Code, re ad in g as fo llo w s : "Every p u b lic u t i l i t y s h a ll fu rn ish , p rovid e and m aintain such s e rv ic e , in s tr u ­m e n ta litie s , equipment and f a c i l i t i e s as w i l l promote the sa fe ty , h e a lth , comfort and convenience o f i t s patrons and the p u b lic , and a s w i l l be in a l l re sp e cts, adequate, s u ff ic ie n t , Just and reasonable * * The C a lifo rn ia Commission has a u th o rity to re q u ire p u b lic u t i l i t i e s to improve t h e ir f a c i l i t i e s under Section 36 o f the P u b lic U t i l i t i e s Act.
