FEB 8 1954 Dear Mr. Hamilton} Section 12 of the contract between the Railroads the Water Company and the Water District provides, among other things, that when the escrow has been opened, or at such earlier time as the parties may agree, the First Party shall file with the Public Service Commission of the State of Nevadaan application requesting authority of said Com­mission to transfer the properties “unless the parties hereto shall agree that such authority is not required”. will sell their bonds and the Water Company will transfer its property to the Water District (and I am getting very much discouraged), I asked Mr. Cory what he thought of that Section and whether we would be required to go to the Nevada Public Service Commission, and I enclose copy of his letter dated February 3rd on this subject. this latter, and after you have had the opportunity so to do, I would be glad to have your respective opinions so we can get a few of these odds and ends cleaned up while the Water District is playing footsies with the bond houses.
