(estimated to be $8,000.00). Peirce Carpet, or its nominee, is granted privilege of entering upon the premises for purpose of making surveys and foundation tests, indemnifying Land Company. Upon exercise of option, Peirce Carpet, or its nominee, prior to delivery of deed, shall enter into agreement with Los Angeles & Salt Lake Railroad Company and its lessee, Union Pacifi Railroad Company, for construction, maintenance, operation and ownership of a spur track to serve the option parcel. Peirce shall not assign this agreement without consent of Land Company, and all terms and provisions of agreement shall inure to the benefit of successors and assigns; be, and the same is hereby, ratified, approved and confirmed.
