Ordinance No. 20,938 (N ew Series) - -An Ordinance fixing the rates for wharfage upon the wharves in the har­bor of Lbs Angeles, fixing the rates for dockage at said wharves, and the charges for handling. freight over said wharves, providing for the licenses for taking tolls on said wharves and prescribing the amount Of such licenses. | The Mayor arid Council of the City of Los Angeles do ordain as follows: Section 1. That ,the fair cash value of each of the wharves in the City of Los Angeles, and the cost of maintenance and repair thereof respectively is hereby fixed as follows: That the value of the wharf of the . Southern Pacific Company is hereby fixed at Tw o Hundred. Twenty-eight Thousand, Five Hundred ($228,500) Dol­lars, .and that the cost o f repair and mairitenance of said wharf is hereby fixed at. Twenty-two Thousand, Eight Hundred F ifty ($22,850) Dollars; That the value o f the wharf of the San Pedro .Lumber Company is hereby fixed at Thirty-seven Thousand Seven Hundred F ifty ($37,750) Dollars, and that the cost o f repair and maintenance of said wharf ^is hereby fixed at Three Thousand Seven Hundred Seventy-five ($3775) Dollars; That the value' of the wharf of the Kerckhoff-Cuzner Mill and Lumber Com­pany is hereby fixed at Seventeen Thou­sand ($17,000) Dollars, and that the cost of repair and ' maintenance o f said wharf is hereby fixed at Seventeen Hundred ($1700) Dollars; That the. value o f the wharf of the San Pedro. That-whenever- the articles above men­tioned shall be passed over, any of the wharves herein mentioned and transferred across that portion of the harbor known as the channel or inner bay of San Pedro, and thence pass over any wharf on the east side of the said channel or inner bay of San Pedro, then and in that event the persons, firms or corporations owning or operating each such wharf shall only be entitled to charge, receive or collect one half of the wharfage- charges herein mentioned. That whenever the handling o f any of said merchandise is done by the crew of any vessel the rate charged for handling the same is hereby fixed at one h a lf of the rates above specified, and such charge shall be applied to shipments transferred from one v.essel to another vessel without the use of a wharf. That 'the rate of wharfage upon all freight o r merchandise other than that which is herein given at a different rate, $hall be ten (10) cents per ton;, of two thousand (2000). pounds, and a reasonable 'charge for handling the same, not to exceed the actual cost of the labor employed. Sec. 3. That for the use o f any wharf the person, firm or corporation owning or operating the same is hereby author­ized to charge the owners of vessels for the privilege of making fast to- said wharves the' following, rates,, commonly called “ dockage” , to wit: R A TE S OF DOCKAGE. Sec. 4. Before any person’, firm or cor­poration owning or operating any wharf shall charge, sue for or collect any toll or wharfage or dockage, such person, firm or corporation must procure, from the City Clerk o f the City of Los Angeles a license authorizing, him to take tolls, wharf age. or dockage for the period end­ing June 30, 1911; and said license shall be issued to such person, firm or cor­poration by the said City Clerk upon the payment of the license fee herein fixed for the said wharves respectively, as fol­lows, to wit: Southern Pacific Company .......... $4500.00 Kerckhoff-Cuzner Mill & Lumber Co. . . . . . . . . . . . . . . . . . . . . . . . . . . 300.00 San Pedro Lumber Company . Company .............. 100.00 The license herein provided to be is­sued shall specify the, rates of wharfage, and dockage, and tolls herein fixed to be charged for the wharf for which said license is issued. -. Sec. 5. It shall be unlawful for any/per-, {son or persons,whether as principal,' clerk, servant,..or agent, or employee, to take, or charge o r collect, or sue for, any wharf - v age or dockage for the use of the said wharves, or any wharf, without first having paid the license fee herein fixed for/said wharf, and having procured the license so to do, as in this ordinance provided. And every person who shall ^Violate any o f the provisions of this ordi­nance relating to. the taking of tolls, wharfage or. dockage, without a license, shall be deemed guilty qf a misdemeanor, and is punishable by imprisonment in the City Jail for a period not exceeding nine­ty (90) days, or by a fine not exceeding Three Hundred ($300) Dollars, or by both such .fine arid imprisonment. 1 Sec. 6. It shall be unlawful for any person or persons, whether as principal; clerk, servant, agent or employee, to ; charge any greater or less rate for wharf­age or dockage than that fixed, by this ordinance. And every person who shall make- such charge in excess of or less - than the rate fixed, shall be •* deemed guilty of a'misdemeanor, and is punish­able as; provided in. Section 5 hereof. Sec. 7. Every charge for toll, wharfage or dockage, without a license, and- each charge- for wharfage or dockage in ex­cess of or less than the rate herein fixed shall be deemed a separate offense, and shall be punishable as herein provided. Sec. 8. The provisions of this ordinance fixing rates shall apply to Owners thereof, as herein stated, to their lessees, or lessors; their agents and assigns, arid where two or more wharves arq owned by the same com’pany, herein named, the’ same rate shall apply to all wharves of said company unless Otherwise herein provide^.; Sec. 9. The license- fee for any wharf not herein expressly mentioned,- shall be, and is hereby fixed at One Hundred ($100) Dollars per annum. • See. 10. It shall be the duty of the City Attorney of the City o f Los Angeles to assist the Tax and License Collector of the City - of Los Angeles in the collection of the license fees herein fixed; and it shall be the duty of the City Attorney to bring suit . for the recovery thereof, against' any person or persons, corpora­tions or co-partnerships, required by this ordinance to . procure . a license, who1- charges or attempts to charge wharfage, dockage or tolls for the • use of any of the wharves herein mentioned; such suit shall be brought in. the name of the City of Los Angeles. Sec. 11; A copy of thife ordinance shall be mailed by the Clerk of the City of Los Angeles to each of the wharf owners herein named, and a printed. or written copy thereof shall be conspicuously posted on each public wharf of each wharf Owner in the City of Los Angeles by the person or corporation owning and Controlling the. same. Sec.. 12. All ordinances and parts of ordinances in conflict herewith are hereby repealed; Sec/ 13. This ordinance is urgently re­quired for the immediate preservation of the public peace* health and safety; and the City Clerk shall certify to its pas­sage by a two thirds vote, of the Coun-^ cil, and cause it to* be published Once in The L qs Angeles Daily Journal and thereupon and thereafter it shall take ef­fect and be in force. I hereby certify that the whole num­ber of members of the City Council of the City of Los Angeles is nine, and that the foregoing ordinance was. passed by a two thirds vote of said Council, at its meeting of September 20, 1910, by the fol­lowing vote; to wi-t: Ayes: Messrs.
