Bracken Mr* Frank Strong Referring to exchange of telegrams with respect to de­mand of one James A* Bowen for additional payment for services rendered to the Las Vegas Land and Water Company* Back in 1944 this question was brought up with respect to John W. Cleveland who was employed as was Mr* Bowen as a watchman for certain properties of the Las Vegas Land and Water Company in Los Angeles. Mr* Cleveland retained an attorney who wrote Mr* Strong stating that Mr. Cleveland had been in the employ of the Union Pacific Railroad Company and waa claiming the extra 9# an hour back pay granted to Union Pacific Railroad Company em­ployees. At that time an Investigation was made and it developed that although Mr. Cleveland was paid on Uhion Pacific Railroad Company checks, they were stamped to the aooount of the Las Vegas Land and Water Company and that no railroad retirement deductions were made but, on the other hand, the State unemployment .and Federal social security deductions were made. The matter was taken up with Mr* Cleveland’s attorney who was advised that Mr* Cleveland was not employed b y Union Paoifio Railroad Company but was employed by Las Vegas Land and Water Companv and carried on the payrolls of that Company* This occurred back in May, 1944 and so far we have heard nothing further from Mr* Cleveland’s attorney* X <nb- the facts are the same in connection with Mr* Bowen’s case and I am enclosing, for your consideration, copy of letter Mr. Strong wrote to Mr* Cleveland’s attorney which you m a y desire to modify and pass on to Mr. Meyers of the Department of Labor with whom you have had some correspondence* I d * Bennett ESB:LS Ene.
