Woodbury being first duly sworn, deposes and says: That he is Auditor of the LAS VEGAS REVIEW-JOURNAL, a daily newspaper, of general circulation, printed and published at Las Vegas, in the County of Clark, State of Nevada, and that the attached was continuously published in said newspaper for a period of 2 insertions from July 27, 1950 to August 3, 1950 inclusive, being the issues of said newspaper for the following dates, to-wit: July 27 & August 3, 1950. That said newspaper was regularly issued and circulated on each of the dates above named. s/ Carl R. My Commission Expires April 14, 1954 ORDINANCE NO. 430 AN ORDINANCE TO AMEND SECTIONS 8, 9 AND 10 OF ORDINANCE NO. 313 OF THE CITY OF LAS VEGAS ENTITLED: "AN OR­DINANCE DEFINING GARBAGE, RUBBISH, DIRT, AND DEAD ANIMALS; REGULATING THE COLLECTION AND DISPOSAL OF GARBAGE, RUBBISH, DIRT AND DEAD ANIMALS IN THE CITY OF LAS VEGAS; THE FEES TO BE PAID THEREFOR, AND MATTERS RELATING THERETO; AND PROVIDING PENALTIES FOR THE VIOLATION OF THE PROVISIONS THEREOF; AND REPEALING OR­DINANCES NO. 138 AND NO. 267, AND PARTS OF ORDINANCES IN CONFLICT THEREWITH." ALSO REFERRED TO AS SECTIONS 8, 12, AND 14 OF CHAPTER 14 OF THE LAS VEGAS CODE. The Board of Commissioners of the City of Las Vegas do ordain as follows: Section 1. Section 8 of Ordinance No. 313, also known as Chapter 14, Section 8 of the Las Vegas Code, is hereby amended to read as follows: It shall be unlawful for any person , other than the City, or its authorized contractor, or his duly appointed agents, to collect, haul, convey or transport any garbage, rubbish, dirt or dead animals; provided, however, that construction rubbish and excavation debris may be removed by duly licensed building contractors. Section 2. Section 9 of Ordinance No. 313 of the City of Las Vegas, also known as Chapter 14, Section 12 of the Las Vegas City Code is hereby amended to read as follows: Each garbage receptacle shall be constructed water-tight and so constructed as to contain not less than three (3) nor more than thirty (30) gallons, provided places of business and public buildings may use garbage receptacles having a capacity not in excess of 36 gallons. Said garbage receptacle shall be provided with handles and tight-fitting cover. Each such receptacle and cover shall be made of metal material as may be approved for such use by the Las Vegas Clark County Health Department. Cover shall not be removed except when necessary to place garbage therein or remove garbage therefrom. Each receptacle and its cover shall be kept clean from accumulating grease and decomposing material. Section 3. Section 10 of Ordinance No. 313 of the City of Las Vegas also known as Chapter 14, Section 14 of the Las Vegas City Code is hereby amended to read as follows: All garbage and loose debris shall be placed in a receptacle provided, however, that tree and yard trimmings may be bundled if securely tied. Such bundles shall not exceed 10 feet in length nor weigh more than one hundred (100) pounds. Before placing garbage in the receptacle, the liquid shall be drained there­from and the garbage shall be wrapped in paper; provided, however, that unwrapped garbage may be placed in metal receptacles having flytight lids; provided further, that such wrapped garbage may be placed in the receptacle with rubbish. Section 4. This ordinance shall be in full force and effect upon its final passage and publication, provided, however, that the provisions of Section 2 hereinabove set forth shall not be enforced prior to January 1, 1951. Section 5. The City Clerk and the Clerk of the Board of Commissioners of the City of Las Vegas, shall cause this Ordinance No. 430 to be published once a week for two successive weeks immediately following its final reading and adoption, in the Las Vegas Review Journal, a daily newspaper published in the City of Las Vegas. APPROVED: Mayor ATTEST: Shirley Ballinger City Clerk s/ Betty Funston Deputy City Clerk The above and foregoing Ordinance was first proposed and read by title to the Board of Commissioners on the 21st day of June , 1950, and referred to the following committee composed of Commissioners Peccole and Whipple for recommendation; thereafter the said committee reported favorably on said ordinance on the 7th day of August, 1950, which was the regular meeting held on the 7th day of August , 1950; that at said regular meeting held on the 7th day of August, 1950, the proposed ordinance, as amended, was read in full to the Board of City Commissioners as first introduced and amended, and adopted by the following vote: Voting "Aye": Commissioners Moore, Peccole, Whipple and His Honor Voting "Nay": Commissioner Bunker _________________________________________________ Absent: None
