Maag Replying to your letter of May 27, 1954, and con­firming our telephone conversation today relative to the proposed change of point of diversion of 2*5 c,f,s, of water from Well No, 1 to the shop grounds, please be ad­vised that I have today requested the office of the State Engineer to grant the application now pending, which, if granted, will transfer the entire appropriation to the existing well. It is my opinion that the existing application would have to be amended in order to include the proposed new well and that such amendment would require a new pub­lication of the application followed by the statutory waiting period. Furthermore, an application for permission to appropriate water from the new well would also have to be made in order to allow drilling beyond a depth of 100 feet, and such application would have to be published and then followed by the statutory waiting period. Therefore, pursuant to my understanding of our \ conversation of this morning, I have requested immediate action on the pending application, with the understanding \ that if and when the new well is authorized and an appro­priate description furnished for the location of the same, we would then combine an application for permission to appropriate with a request for transfer of point of diver sion of a portion of the water which had been transferred the existing shop well. It may be, however, that Roscoe Moss Company will wish to change its proposed bid for the new well if it cannot proceed with the same immediately after completing the two wells which it is presently drilling for the Water Company. It is my opinion that a minimum of 60 days would be required from the time of initial application before drilling could be commenced.
