MINUTES Las Vegas, Nevada October 7, 1959 A regular meeting of the Board of Commissioners of the City of Las Vegas, Nevada, held this 7th day of October, 1959; was called to order at the hour of 7:30 P.M. with the following members present: Mayor Oran K. Gragson Commissioner William H. Elwell Commissioner E. W. Fountain Commissioner Reed Whipple Acting City Manager Robert D. Heath City Attorney Calvin M. Cory Public Works Director Richard P. Sauer Planning Director Franklin J. Bills City Clerk Marjorie Holtschlag Absent: Commissioner Harris P. Sharp VACATION; PORTION This being the time heretofore set for public hearing regarding the vacation of a NORTH 15TH STREET portion of the right-of-way along the east side of 15th Street between Stewart and Ogden Avenues, Vacation Petition (V-4-59) received from Dudley, Washburn, Williams, Public Hearing. Covello and Rost, His Honor Mayor Gragson asked if there were any objections to this vacation and none were voiced or filed. Order Adopted Commissioner Whipple moved the following Order of Vacation be adopted and copy of order filed with the County Recorder of Clark County: ORDER OF VACATION A Petition, dated the 17th day of June, 1959; signed by nine (9) freeholders residing in the area affected, having been filed with the Clerk of this Board, petitioning for the vacation of a portion of a certain right of way along the east side of 15th Street between Stewart and Ogden Avenues, hereinafter described, and said petition having been by order of this Board referred to the City Planning Commission having filed its report, dated August 13, 1959; with this Board approving and recommending such vacation; And this Board, by an order made at its regular meeting held on the 19th day of August, 1959; set the 7th day of October, 1959; at the hour of 7:30 P.M., in the Council Chambers of the City Hall, 5th & Stewart Streets, in the City of Las Vegas, Clark County, Nevada, as the time and place for a public hearing on said petition and recommendation, and ordered the City Clerk to cause the aforesaid street and part thereof proposed to be vacated to be posted with a notice setting forth the time and place of the public hearing and the extent of the proposed vacation; And it appearing from the affidavit of Dwight Engebregson filed with the Clerk of this Board, that the notice provided for in said order, a copy of which notice is attached to said affidavit, was posted on the 28th day of August, 1959, in the manner prescribed by said order; And this being the time fixed for the hearing on said petition for vacation and the recommendation of the City Planning Commission thereon, and this Board having heard evidence in support of and there being no opposition to said petition and recommendation; And it appearing to the satisfaction of this Board that the portion of the right- of-way preposed to be vacated is no longer required for the public use and convenience, and that said vacation will enure to the benefit of the City of Las Vegas, and that neither the public nor any person will be materially injured thereby; IT IS HEREBY ORDERED that the following described portion of a right of way along the east side of 15th Street between Stewart and Ogden Avenues, in the City of Las Vegas, to wit: A certain tract or parcel of land lying and being situate in the City of Las Vegas, County of Clark, State of Nevada, and being a portion of the Southeast One-Quarter (SE¼) of the Northwest One-Quarter (NW¼) of Section 35, Township 20 South, Range 61 East, M. D. B. & M., and being more particularly described as follows, to wit: That portion of irregular shape, Block 21, 14th Street Addition to the City of Las Vegas as shown by map thereof in Book 1 of Plats, Page 82, in the Office of the County Recorder, Clark County, Nevada, and more Particularly described as follows, to wit: Beginning at the most Easterly corner of said Block 21, thence North 61° 47' 00" West along the Northerly line thereof and the Southerly right-of-way line of Stewart Avenue a distance of 90.08 feet to the point of intersection of the Easterly right-of-way line of North 15th Street (80 feet in width) thence South 28° 13' 00" West along said easterly right-of-way line a distance of 5.02 feet, thence along a curve to the left tangent to the last described course having a radius of 318.42 feet subtending a central angle of 07° 39' 38" an arc length of 42.57 feet to a point on the Southerly line of said Block 21, thence North 89° 40' 00" East along the Southerly line thereof a distance of 99.32 feet to the point of beginning, containing .044 acres more or less; be and the same is hereby vacated.
