Bennetts The hearing on the above entitled matter before Commi sal oners Sexton and. Smith, was had Saturday, June 17th, 1939, at the Court House in Las Vegas, The Complainant appeared for himself, and the Land and Water Company was represented by me and Mr. A1 Folger of Mr, Bracken’s office, Mr. Beckley stated that he was the owner of Lot H in Bark Place Addition, which Lot H ia located on Fifth Street about 400 feet south' of Charleston Boulevard} that he intends to build a residence and some nine units of an auto court on this let. It will cost him about $15 ,000.00, That his plans and specifications are prepared and have been submitted to contractors who have made him bide, but that he was not in a position to accept the bids Inasmuch ae he could not get water from Lae Vegaa Land and later Company; that he had asked Mr, Bracken for permission to connect to the Water Company’s mains on Charleston Boulevard, and wae refused. That at the time be made the application he would, have been willing to have advanced the cost of running the line to hie let, but now that he had to complain to the Public Service Commission, he was no longer willing to do so. That there were now seven owners of Lots in said Addi­tion who, at their own expense, had connected their separate lines with the Lae Vegas Land and Water Company4 a mains on Charleston Boulevard. That there were about four other users and at least two prospective users beside, himself in Park Place Addition who would.be willing to take water provided a line was run. That four of these prospective users were now getting water from Boulder Dam Syndicate, but that Boulder Dam Syndicate had a certificate of convenience covering only Boulder Addition. That there was an artesian well belonging to S. J. Lawson on Lot B of Park Place Addition and one on Lot 5 owned by A1 Coradsttl; that the Coradctti well was not now flowing, but the Lawson well flowed some four or five inches. 1
